Facts:
Mr Oatham lodged an information with the Judicial Committee alleging a breach of Rule 638(3)(b)(ii) in that Apprentice Jockey, Holly Andrew used her whip excessively in the home straight.
Rule 638(3) (b) (ii) reads: "A Rider shall not: - (b) strike a horse with a whip in a manner or to an extent which is: (ii) ... excessive."
The whip guidelines read:
Inside the final 600 metres of any Race, official trial or jump-out a horse may be struck with the drawn whip up to five times after which the rider must cease their use of the whip for a minimum of five strides before striking the horse again with the drawn whip, with this restriction to apply prior to the final 100 metres. The whip may then be used at the rider’s discretion until the winning post is reached. Prior to the final 600 metres of a race, official trial or jump-out the use of the drawn whip is acceptable if used in moderation and not continually.
Ms Andrew acknowledged she understood the rule and confirmed her admission of the breach. She was assisted at the hearing by Mr Noel Harris.
Mr Goodwin used the head and side on videos to show the Committee where Ms Andrew had exceeded the whip guidelines. Between the 600m and 100m she hit her mount approximately 12-14 times with a maximum break of three strides between strikes.
Ms Andrew agreed with the Stewards’ interpretation of the video and calculation of whip use.
Mr Harris said in his opinion the younger riders are overriding and becoming impatient. They have to learn to count the number of whip strikes.

Mr Oatham said Ms Andrews last breached this rule one week ago at the Taranaki meeting where she was fined $300. Clearly today she was well outside of the whip guidelines but he said at least she was breaking up the strikes. She was just not stopping for long enough and this was an area Ms Andrew has to work on. The Stewards submission was for a monetary penalty in line with a second breach.
Ms Andrew said she was disappointed with herself for breaching the whip rules. She explained how she thought she was going to win the race and she just got carried away.
Reasons for Penalty:
New whip guidelines were introduced on 1st August this year (1/8/17). To reflect these changes the penalty guidelines for Judicial Committees were also adjusted.
The updated starting points for breaches of Rule 638(3) (b) (ii) are:
1st breach - $300
2nd breach - $500
3rd breach - 3-5 day suspension
As Ms Andrew was facing her second charge of excessive whip use the Committee adopted a starting point of $500. In assessing the severity of the breach we note that Ms Andrews did not use the whip in a continuous manner and her strikes were not overly forceful. In our opinion the breach sat in the low-mid range and did not warrant any uplift in penalty.
While we were concerned that Ms Andrews breached this rule only one week ago we must take into account the fact that the guidelines have only recently changed. We also had consideration to Ms Andrew’s comments, in particular her remorse and her strong desire to lessen her whip use. It was our opinion that a $500 monetary penalty was appropriate on this occasion.
