Following the running of Race 8, The Mudgeway Stakes Group 1, Mr. Symes was charged with careless riding under Rule 871 (1) (d).



Following the running of Race 8, The Mudgeway Stakes Group 1, Mr. Symes was charged with careless riding under Rule 871 (1) (d). The information alleged that J.Symes the rider of Bulginbaah shifted outward in the home straight when not clear of Wahid (H.Tinsley) who had to check.

Mr. Symes admitted the breach.

Mr. George called on Mr. Goodwin to outline the incident on video. He showed how Wahid was racing free of any interference when Mr. Symes, soon after turning into the home straight, angled his mount Bulginbaah out into the path of Wahid causing Mr. Tinsley to check.

Mr. George told the committee that Mr. Symes shifted out when looking for clear racing room and in doing so threw caution to the wind. In his opinion the incident was severe, it occurred in a Group 1 race and Mr.Symes had shown no care to his fellow riders. He was trying to win irrespective of the interference he caused. Mr George said the repercussions of careless riding such as this could be severe. He asked the committee to consider a one month suspension.

Mr. Symes riding record shows no careless riding charges issued within the last twelve months. This was confirmed by Mr.Symes.

Mr Castles asked Mr.Symes about the number of rides he has and he responded that he does not get very many.

Mr. Symes told the committee that he considered a one month penalty too harsh considering that it had been over twelve months since he had incurred a careless riding charge. While admitting his actions had been careless he said that he was only trying to give his horse every chance in a group race by finding clear racing room. He said that he did not think the interference was very bad, he had not forced Wahid to clip heels but merely put him off balance. Mr. Symes did not consider that the interference Wahid suffered had affected that horses chances of running in the money.

Mr. George concluded by saying that the interference was caused by straight out carelessness and not any inexperience on the behalf of Mr.Symes.

Penalty

In coming to a decision on penalty the committee took into account all of the submissions put before it including the mitigating factors of Mr.Symes frank admission of the breach and his very good riding record.

However this was a Group 1 race and the committee had regard under Rule 1122 (2) to the status of the race and the stake payable.

--

There is no doubt that Mr. Symes riding was careless and that penalty must be by way of suspension but it is the opinion of the committee that a one month suspension, as suggested by Mr. George, was too severe for the nature of the interference.

Mr Symes was suspended from riding from the conclusion of racing on Wednesday September 6th until the conclusion of racing on Saturday September 23rd.
