Following the running of Race 10, Mr.R.J.Hannam was charged with careless riding under rule 871 (1) (d).



Following the running of Race 10, Mr.R.J.Hannam was charged with careless riding under rule 871 (1) (d). The information alleged R.J.Hannam the rider of Happy Harry allowed his mount to shift out when not clear of True Power (D.Bradley) who had to check.

Mr. Hannam did not admit the breach.

Mr. George called on Mr. J.Oatham to outline the alleged incident by way of video. Mr. Oatham showed Mr Hannam angle his mount Happy Harry out sharply in the home straight taking the line of Mr.Bradley causing him to check his mount. Mr Oatham believed that Mr. Hannam had moved out four horse widths and was less than a length clear at the time of the incident. He indicated using the head-on film that Tatlock (Ms.L.Cropp) had moved inwards slightly but her actions contributed very little, if any, to the incident.

Mr George asked Mr.Hannam if he was the required distance clear to which Mr.Hannam replied, "possibly not". He told the committee the check to Mr.Bradley was severe. Safety is paramount and he believed Mr Hannam was careless.

Mr.Hannam admitted that he had come out looking for a run but he believed that Ms.Cropp contributed to the interference on Mr.Bradley by moving inwards. Mr Hannam called Mr Bradley as a witness who told the committee that there was a little bit of movement from Ms.Cropp on his outside. In response to questions Mr.Bradley said that while there had been no direct contact with Happy Harry his horse was carried outwards by Mr. Hannams mount.

Mr.George, in summing up, conceded that there was a slight shift from Ms.Cropp and it may have had some bearing on the incident however the major cause of the interference was from Mr Hannam. If Mr.Hannam had not moved outwards Mr. Bradley would not have had to check his mount. He also asked the committee to take into account the rear view film of the incident that showed Mr Hannam eventually ending up directly in front of Mr.Bradley's mount.

Decision

--

The committee had careful regard to all of the submissions put before it. We viewed the films at length, and in detail, paying particular attention to the position of Ms.Cropp riding Tatlock. While she did move inward it was minimal and it was the opinion of the committee that the movement from Mr. Hannam was the major cause of Mr. Bradley getting into trouble.

His outward movement carried Mr. Bradley wide and then he crossed in front of Mr. Bradley when not the required distance clear. This was very clear on the rear view film.

--

The charge of careless riding was proved.

--

Penalty

--

Mr. George asked the committee to consider the carelessness shown by Mr. Hannam in that he caused a serious check to Mr. Bradley causing him to nearly clip heels. He said that there were mitigating circumstances referring to Ms.Cropp moving inwards a little from the outside.

Mr. Hannam's last charge of careless riding was in January 2004 and even though Mr.George agreed it was a good record he asked for a suspension of two weeks.

Mr Hannam told the committee that he believed a period of two weeks was too harsh. Last season he had over 500 rides and did not incur a suspension, his record speaks for itself. He said that his actions on this occasion were certainly not malicious.

--

In relation to penalty the committee took into account all of the submissions particularly Mr.Hannam's exemplary riding record. He is a busy rider and much credit must be given to such a clean record.

--

We also accepted that Ms.Cropp moved inwards which did not cause the interference to Mr Bradley but contributed to the severity of it.

--

Taking into account all of these reasons and the fact that it was a premier race day it was the opinion of the committee that a suspension was the appropriate penalty.

Mr.Hannam was suspended from riding from the conclusion of racing on Wednesday September 6th until the conclusion of racing on Wednesday September 13th.
