Following Race 7 an information was filed pursuant to Rule 871(1)(d) when it was alleged by the Informant, Mr LN McCutcheon, that Mr O Bosson the rider of DISTINCTLY SECRET allowed his mount to shift out and force LASHED over extra ground near the 800 meter mark.
| -- DECISION AND REASONS --Following Race 7 an information was filed pursuant to Rule 871(1)(d) when it was alleged by the Informant, Mr LN McCutcheon, that Mr O Bosson the rider of DISTINCTLY SECRET allowed his mount to shift out and force LASHED over extra ground near the 800 meter mark. Mr Bosson admitted the breach of the rule. --Mr McCutcheon demonstrated the video films and showed DISTINCTLY SECRET angle out sharply and make contact with LASHED on his outside pushing this horse off its rightful line of running. --Mr Bosson, the rider of DISTINCTLY SECRET admitted he pushed out but said his horse laid on LASHED's shoulder making it look worse than it was. ----Penalty: --Mr McCutcheon produced Mr Bosson's record, which showed he had not been charged this year. Despite this he believed that as this was a $1 million dollar race and LASHED was forced from racing two wide to four wide, a suspension was appropriate. --Mr Bosson did not make any submissions when asked. --Decision: --The committee considered all submissions and in imposing a penalty considered Mr Bosson's very good record and his guilty plea, however, given the status of the race we agree a suspension is necessary. Accordingly we suspend Mr Bosson from riding from the conclusion of racing on the 6 October 2004 until after the conclusion of racing on the 13th October 2004 |
