As Mr Parkes admitted the breach and the Committee finds the charge proved.

Penalty:

Mr Parkes is suspended from the close of racing on Saturday 5 March 2016 to the close of racing on Thursday 24 March 2016. The Committee calculates that to be 10 riding days as follows:-

Facts:

Following the running of race 1, the “HOY 1-6 March 2100m”, Information A3369 was filed by Stipendiary Steward Mr G Whiterod under Rule 636(1)(d). The Information stated “J Parkes (Balham) failed to ride his mount out fully to the finish”.

Rule 636 (1) (d) states “A person…..being the Rider of a horse in a Race, must ride his horse out to the end of the Race if there is a reasonable chance of it running into a position for which there is prize money to be awarded or a dividend to be declared”.

At the beginning of the hearing Mr Parkes confirmed he understood the Rule under which he was charged and also that he admitted the breach of the Rule.

Submissions for Decision:

Mr Whiterod, using the side-on film, identified Mr Parkes at the 150m mark racing closest to the rail behind “Nymphe Monte” and to the inside and ahead of “Kairanga Lad”. He said the Stewards had no concerns about Mr Parkes’ ride at this point of the race. He said Mr Parkes continued to ride with vigour until inside the 50m mark and was continuing to hold “Balham” but then approximately 4 strides from the finish he eased his riding and was beaten on the line for second by a nose. Using the head-on film Mr Whiterod said there was no visual evidence to show why Mr Parkes may have had to stop riding his horse out to the finish.

Mr Parkes said he did not agree he eased for 4 strides but rather it was only 2 strides before he stood up and thought saying it was 4 strides was “taking the mickey”. He accepted that whatever the number of strides was it would not change the outcome of the hearing.

Submissions for Penalty:

Mr Whiterod said Mr Parkes had not breached this Rule in the previous 12 months. He said Mr Parkes had admitted the breach of the Rule but his actions had cost his horse second placing in the race having been beaten for that placing by a nose. He said this meant the owners of “Balham” had had earned $2,250 for running third which was 50% of the stake money for running second and the punters who had backed “Balham” to finish second had also been disadvantaged. Mr Whiterod said he was aware of the JCA Penalty Guidelines which stated a starting point for a breach of this Rule involving being beaten for second place was a 4 week suspension but he did not submit what the Stewards believed was an appropriate penalty in this case.

Mr Parkes had no submissions to make on penalty other than to seek a deferment of the penalty until after the close of racing on Saturday 5 March 2016.

Reasons for Penalty:

The Committee has reviewed the films of the final 50m of the race. Mr Parkes has admitted the breach and the only point of difference between Mr Whiterod and Mr Parkes is that Mr Whiterod says Mr Parkes eased his riding of “Balham” 4 strides before the finish and Mr Parkes says he was only 2 strides from the finish before (using his own words) he stood up. The Committee is clear that it was definitely not 2 but at least 3 strides before the finish when Mr Parkes eased his riding of “Balham” but confirms that the outcome of the hearing does not hang on whether it is 3 or 4 strides. Whilst the Committee views the breach of the Rule seriously we believe Mr Parkes simply misjudged where the finish line was and more importantly the finishing speed of “Kairanga Lad”.

The JCA’s Penalty Guidelines state the starting point for a breach of this Rule is suspension of 4 weeks but notes Mr Whiterod did not submit what he believed was an appropriate penalty. The committee is aware of a recent almost identical incident on 20 January 2016 at Te Rapa when jockey Lisa Allpress was suspended for 10 riding days when beaten a short margin for second and has decided an appropriate penalty on this occasion is a similar period of suspension. The Committee notes that Mr Parkes has ridden from time to time in the northern region in recent months and is aware that he is riding at Ellerslie on Saturday 5 March 2016 and was intending to ride there the following week with a confirmed ride in the Auckland Cup.

Mr Parkes’ request for a deferment until after the close of racing on Saturday 5 March 2016 is agreed to in terms of Rule 1106(2).
