As Mr Bishop admitted the breach, it was deemed to be proved.

Penalty:

Accordingly, Mr Bishop’s riding license is suspended from the close of racing on Thursday, September 24th up to and including racing on Saturday, October 3rd, 2020.

Facts:

Following the running of Race 6 (El Roca – Sir Colin Meads Trophy Listed Race), an Information was lodged by Mr Goodwin alleging a breach of Rule 638(1)(d) in that R Bishop allowed his mount KOBE ROCKS to shift in when not sufficiently clear of CUTTING EDGE which was checked near the 400 metres.

Mr Goodwin had Mr Jones explain the incident using the videos. He began by showing the field at the 600m. Mr Bishop was racing in a position outside of CUTTING EDGE (Shaun McKay) with another runner between Mr McKay and the rail. Mr Jones described the racing as “tight”.

Near the 400m Mr Bishop allowed his mount to move in half a horse-width leaving insufficient room for the two horses to his inside. As a result, Mr McKay was forced to check backwards.

Mr Bishop explained that on the point of the corner he was racing to the immediate outside of Mr McKay who was struggling to hold his spot but at the same time trying to hold Mr Bishop out. He described this as competitive riding. Mr Bishop conceded that his mount ducked in a fraction which caused Mr McKay to check backwards.

Submissions for Penalty:

Mr Goodwin produced Mr Bishop’s riding record which showed his last careless riding charge was at Otaki on 31/7/20. Mr Goodwin described today’s breach as low range and submitted that a term of suspension be imposed.

Mr Bishop advised of riding commitments through until Thursday September 24th.

Reasons for Penalty:

The Committee considered all submissions.

Mr McKay was entitled to his position on the inside of Mr Bishop, but Mr Bishop’s horse was travelling the better of the two. We accept that Mr Bishop did not move inwards very much but due to the tight racing at the time it was enough to cause a sharp check to Mr McKay. The Committee placed the degree of carelessness in the mid to low range.

Mr Bishop’s record was considered a neutral factor since he had a careless riding charge only 2 months ago. In mitigation was Mr Bishop’s admission of the breach however the Listed status of the race was an aggravating factor.

Under normal circumstances the Committee would have imposed a suspension of 8 days, however we have had regard to the impact of Covid 19, and the restrictions this has placed on riders.
Balancing up all factors, it was the Committee’s opinion that a suspension of 5 days was appropriate.
