Mr C Ormsby confirmed that he did admit the breach of rule 871 (1) (d) in that he directed his mount STOLEN THUNDER out near the 350 metre mark when not clear of DISCOVERY BAY (K. Hercock) resulting in DISCOVERY BAY being checked.

Mr C Ormsby confirmed that he did admit the breach of rule 871 (1) (d) in that he directed his mount STOLEN THUNDER out near the 350 metre mark when not clear of DISCOVERY BAY (K. Hercock) resulting in DISCOVERY BAY being checked.

The films were made available but as they had been shown during the protest it was accepted that they were not required to be viewed again. However, Mr. A. Scott asked for the head on film to be shown and although he concurred with Mr. Ormsby guilty plea he believed that there was a mitigating circumstance that contributed in the incident. He felt that there was slight inwards movement from Miss Hercocks mount.

Stipendiary Steward, Mr. N. Goodwin, in reply concurred that the movement inward was slight and that it did not contribute at all to the incident.

Submissions on penalty were called for and Mr. Goodwin outlined Mr. Ormsby charges under this rule. He felt it was an appalling record and this charge should be reflected in a severe term of suspension. Mr Ormsby and Mr Scott had no comment, but agreed with the previous charges as outlined.

In arriving at their decision on penalty the committee considered carefully the submissions put forward. They were unimpressed with Mr Ormsby's record under this rule. It does not make good reading.

Mr Ormsby did admit the charge, and his employer Mr. Scott while agreeing with his jockey's admittance of the rule did submit there was mitigating circumstances.

Mr Goodwin believed it was an appalling bad record and while there may have been some slight movement inwards by Miss Hercocks mount, it did not excuse Jockey Ormsby from taking the action that he did.

Mr. Goodwin reiterated that the charge came from the first part of the combined incident (as the horses first rounded the bend). Mr Ormsby agreed with his record on this charge as submitted by Mr Goodwin. He said he was under pressure to perform, the horse was expected to win.

The fact that he was suspended at the Te Aroha race meeting on the 18th October 2006 until the 4th of November did not allow for Mr Ormsby to give the committee a clear indication of his riding programme. However, on reconvening Mr. Ormsby was given the opportunity to comment and confirmed he would be riding for the O?Sullivan Stable during the NZ Cup Meeting.

The committee was aware that along with Mr Ormsby's admittance of the breach, the penalty does include three premier days including the NZ Cup Carnival. We were also aware that these premier days are important race days on the racing calendar but felt the degree of carelessness shown by Mr Ormsby and his appalling record could not be allowed for by any reduction to reflect the premier days importance. We felt the penalty should reflect the concerns about Mr Ormsby's record under this rule and on this occasion his blatant regard for the rule by placing fellow jockeys in positions where there could be serious consequences.

Mr Ormsby is suspended from riding from the completion of racing on Saturday the 4th of November until the completion of racing on Thursday the 23rd of November.
