Stipendiary Steward, Mr N Goodwin, read Rule 912 emphasizing in particular - "prevented from taking an effective part in the race owing to the mechanical failure of starting stalls, or is denied a fair start and such occurrence materially prejudiced the chances of that horse (but not where a horse is slow away by its own accord) the judicial committee shall order that the amount paid on the purchase of the ticket be refunded on production of the ticket".

--Mr Goodwin called Jockey Mr C Ormsby, the rider of SCILLA. He informed the committee that prior to the start his horse was unsettled. He called to the starter that his horse was not ready, and an attendant came up alongside and it was his belief that the attendant was holding his mount by the ear as the gates opened. He used the head-on film to indicate his horse leaving the stall but the quality of the film and the distance away from the camera did not show whether the attendant was holding any part of the horse as the gates opened.
--Starter, Mr G Phillips, informed the committee that he didn?t hear Jockey Ormsby call but did confirm the horse was fractious and an attendant was alongside. He felt that the horse was rocking around but that it did straighten in the stalls prior to the jump. It did jump sideways tending to suggest that there was a possibility it was held. Mr Goodwin had no comment to make.
--Mr G Richardson asked for the rule to be read again and reiterated that he believed the horse was slow away but NOT by its own accord. He told the committee that he was adamant the horse was held either by the ear or bridle at the point of the jump. He told the committee that the TV film showed that.
--Decision and Reason:
--The committee carefully considered the arguments put forward. The head-on film was of little use in assisting the committee to make its decision. The time factor prohibited a detailed view of the TV film and the chairman felt he was unable to accept that film as evidence. In making its decision the committee relied on the statements of both the Jockey Ormsby and trainer Mr Richardson, and considered the following points:

- The dividends were only affected by the reduction of the number on the race (total pool). --
- No stake money was involved --
- The horse did not finish in the first 6 placings
In reaching their decision, the committee relied on the evidence of both Jockey Ormsby and trainer Mr Richardson. Starter, G. Phillips, confirmed that the horse was fractious and that an attendant was alongside at the jump, whether he had a hand on the horse he was unsure and he had not spoken to the attendant, but did consider that the horses actions upon the gates opening did tend to suggest the horse may have been held.
--Considering the evidence given, the committee was of the opinion that SCILLA be declared a non-runner in Race One and all investment on that horse is refunded.
