Penalty:

Mr Lammas' licence is suspended from the close of racing on Saturday 21 May until the close of racing on Sunday 29 May. This incorporates the Counties (25th), Otaki (26th), Auckland/Wellington (28th) and Egmont (29th) meetings.

Facts:

Following the running of Race 2 (Dow Agro-Sciences 2100m) Information A3372 was filed with the judicial committee. It alleged a breach of Rule 638(1)(d) and stated "Interference in the home straight."

Mr Lammas confirmed that he understood the rule and that he admitted the breach.

All available films were viewed during the hearing. Using the head-on film, Stipendiary Steward Mr Goodwin identified Mr Lammas' mount (EL CORREDOR) approaching the 200 metres. Located to his immediate outside was NAPOLEON (H Tinsley), then SUNSET GIRL (S Collett) to its outside and MR ENTHUSIASTIC (M Tanaka) to its outside. He pointed out that Mr Lammas had nowhere to improve, and as such he had angled his mount out when not the required distance clear of NAPOLEON. This meant Mr Tinsley had to take a hold of his mount in order to ease off the heels of Mr Lammas. Mr Lammas had continued with his outwards movement, which had dictated SUNSET GIRL out on to Mr Tanaka who had to take corrective action.

Mr Lammas stated that he had simply misjudged the distance that he was clear as he had looked to his outside and saw Mr Tinsley; however, he thought NAPOLEON was not going as good as his own runner. Mr Lammas believed that it was a simple misjudgement on his part.

Submissions for Penalty:

In presenting Mr Lammas' record, Stipendiary Steward Mr Whiterod submitted that he had a very good record with one previous breach of this rule over the previous 12 month period. This was at the Whangarei Meeting on 29 August 2015, for which he received a four day suspension. He also believed that the level of carelessness sat within the low range. He submitted a period of suspension as appropriate.

Mr Lammas advised the committee that any period of suspension could commence after racing this coming Saturday. He believed he was a rider who rode throughout the North Island and also asked the committee to consider his good record when determining penalty. Mr Whiterod confirmed that Mr Lammas rode throughout the North Island. 

Reasons for Penalty:

The committee considered all of the submissions placed before it and determined that a period of suspension was appropriate; adopting a five day starting point. In mitigation we applied Mr Lammas' very good record and his early admission of the breach. We independently assessed the level of carelessness to be placed at the low-end. Mr Lammas' carelessness caused inconvenience to three runners, including an impediment to their momentum. While this was clearly evident on the available films, the committee accepts that Mr Lammas made a simple error of judgement on this occasion. We considered a four day period of suspension as appropriate.
