Facts:

Following the running of Race 9 (Bay Ford NZ Punter Of The Year 1 October 1400), nformation No. A6976 was filed with the Judicial Committee. It alleged a breach of Rule 638(1)(d) by Jockey Mr M Tanaka. The Information stated M Tanaka, rider of SHADOWS CAST allowed his mount to shift in crowding MAE WEST onto THORN PASS which was checked, hampering AWESOME GOAL.

Rule 638(1)(d) provides:
A rider shall not ride a horse in a manner which the Judicial Committee considers to be…(d) careless.

Mr Tanaka acknowledged that he understood the Rule, the charge and confirmed to the committee that he admitted the breach.

Mr Goodwin identified the runners concerned on the film replays and said that near the junction down the back straight Mr Tanaka angled his mount inwards when not clear of MAE WEST and dictated that horse into the line of THORN PASS which was checked. Mr Goodwin said that when Mr Tanaka shifted he was only ¾ to 1 length clear of MAE WEST.

Mr Tanaka said that it was pretty straight-forward in that he came across. He said that he did not realise that there was a horse inside MAE WEST until he heard some calling and he then realised what had happened.

Submissions for Penalty:

Mr Oatham said that Mr Tanaka had a clear record since returning to New Zealand racing in January 2016 and that consideration should also be given for his admittance of the breach. He said that the Stewards saw the carelessness in the mid-range or perhaps a little higher. Mr Oatham submitted that a suspension in the 4-5 days region would be appropriate. During discussion with both parties it was established that Mr Tanaka was a Central Districts rider only.

Mr Tanaka said that he would like any suspension to commence after racing at Otaki on 22 September 2016.

Reasons for Penalty:

The committee considered all submissions that had been made. The film replays showed that Mr Tanaka angled his mount inwards somewhat abruptly into the rightful running line of MAE WEST who was forced down onto THORN PASS who received a relatively severe check and as a consequence lost some lengths. The committee was mindful of the JCA starting point of 5 riding days suspension for careless riding. However believed an increase to 6 days was appropriate considering the degree of carelessness (above mid-range) and the consequences of such riding.

Taking into account Mr Tanaka’s good record and his admittance of the breach, reduced the suspension to be imposed to one of 5 Central Districts riding days.
