Facts:

Subsequent to the running of race 8 (Windsor Park Plate), Information No.A6975 was filed with the Judicial Committee. It alleged a breach of Rule 638(1)(d) by Mr C Lammas (Licensed Jockey). It stated that C Lammas, rider of EL PESCADO allowed his mount to shift out near the 200m when not clear of BATTLE TIME which was checked.

Rule 638(1)(d) provides:
A rider shall not ride a horse in a manner which the Judicial Committee considers to be…(d) careless.

Mr Lammas confirmed that he admitted the breach and said that he understood the Rule and the charge that had been preferred against him.

All films were shown and Mr Goodwin said that early in the run home Mr Lammas was denied a run and that near the 200m he angled his mount outwards and tightened BOHEMIAN LILY (S Collett) and BATTLE TIME (V Colgan) who was the worst affected. He said the Mr Lammas shifted when not clear to do so. In response to a question from the committee, Mr Goodwin said that Mr Lammas and his mount were not more than one length clear when shifting out. He added that there was not any movement inwards from outside runners.

Mr Lammas for his part said that he did come out one horse width and gave a little bump. He said Sam Collett did not stop riding, and that KAWI on the outside had rolled in a fraction. He said that Vinny (BATTLE TIME) did not get a bad check and only lost half a length.

Submissions for Penalty:

Mr Oatham said that Mr Lammas had a good record in that he had only incurred one suspension for careless riding during the past 12 months. He submitted that credit should be given for his good record and his admission of the breach. He said an aggravating factor was that it was a Group 1 race with a stake of $200,000. Mr Oatham placed the carelessness in the higher side of the mid-range category and recommended that a suspension in the 6-7 riding days range would be a suitable penalty.

Mr Lammas responded by saying that he would like to be back riding on 1 October as he had been booked to ride EL PESCADO on that date. He said that he rides everywhere in New Zealand and that his record was very good.

Mr Oatham provided confirmation that Mr Lammas does ride mid-week in the Central Districts but had not ridden mid-week in the South Island this year. Mr Lammas advised the committee that he was to ride at Matamata on 21 September 2016.

Reasons for Penalty:

The films clearly showed that Mr Lammas was denied a clear run ahead prior to the 200m. At about the 200m mark the film evidence showed that Mr Lammas angled his mount outwards when not sufficiently clear of BOHEMIAN LILY and BATTLE TIME, with the latter horse being tightened and jostled and losing valuable ground at a crucial stage of the race.

The committee, adopting the JCA penalty guideline starting point of 5 riding days suspension, believed that an uplift of 2 days was justified due to the degree of carelessness (upper-mid range) and the fact that the carelessness occurred in a Group 1 race affecting two horses. Credit was given for Mr Lammas’ good record and his admission of the breach, with the committee determining that a suspension of 6 riding days was an appropriate penalty.
