As Mr Stackhouse admitted the breach the charge was found to be proved.

Charge:

Mr Oatham lodged an information with the Judicial Committee alleging a breach of Rule 330 (3) (c) in that D Stackhouse failed to make the carded weight for IMANI.

Facts:

Mr Stackhouse was engaged to ride the horse IMANI for trainer Terri Rae in race 7 today, the PGG Wrightson East Coast Premier over 1200m. Around the time of Race 1 it came to the Stewards’ attention that there had been a change of rider and that Mr J Waddell was to ride the horse. Mr Stackhouse had notified Mrs Rae, the trainer of the horse, at 7.30am that he would not be able to make the weight however the Stewards only heard of this news second-hand at approximately 11.45am. Both Mrs Rae and Mr Stackhouse had assumed that the other would notify the Stewards when in fact neither party did so.

Mr Stackhouse told the committee that he had been up since 2.30am in the spa trying to get his weight down and then went for a big run when he arrived at the racetrack however he could only get to 55kgs. He rang Mrs Rae at 7.30am and told her that he couldn’t make 54kgs assuming that she would notify the Stewards of the change.

Submissions for Penalty:

Mr Oatham told the committee that Mr Stackhouse was a senior apprentice who had battled with weight throughout his career. In 2008 he had three charges in quick succession but his only recent charges (for not making the correct weight) were in Victoria on 27/6/11 and 20/8/11 where he was fined the sum of $200 on each occasion. Mr Oatham submitted that an appropriate penalty for this breach was a fine in the vicinity of $200 to $400.

Reasons for Penalty:

The committee considered all of the submissions. The only mitigating factor for Mr Stackhouse was his admission of the breach. Aggravating features were the fact that this was his third overweight charge in approximately four months (we did not take into account the charges from 2008) and his oversight in failing to notify the Stewards that he was overweight today. Mr Stackhouse conceded that it was his responsibility to do so. The committee reminded him of his obligations and the need for early notification of any changes to the authorities so that all relevant information can be passed on to the betting public at the earliest opportunity.
