As Mr Innes admitted the breach the charge was found proved.

Penalty:

The committee adopted a starting point of 5 days suspension but taking into account all of the above factors we suspended Mr Innes’s license to ride for 4 days. He is suspended from riding from the close of racing on Saturday September 24th up to and including racing on Friday September 30th.

As Mr Innes indicated to the committee that was not seeking rides in the South Canterbury area we did not include the race meeting on Monday September 26th in the penalty.

Charge:

Following the running of Race 7, the PGG Wrightson East Coast Premier1200m, an Information was lodged by Mr J Oatham alleging a breach of Rule 638(1) (d) in that passing the 1100m L Innes the rider of BEAUTIFUL GIRL permitted his mount to shift in causing crowding to YELRACM and WORTHING which were checked. Mr Inness initially denied the charge but indicated to the committee that he wanted to change his plea to admit the breach.

Facts:

Mr Goodwin gave his interpretation of the incident using both the head and side on films. Soon after the start Mr Innes, racing three off the rail, moved inwards looking for a rails run but was not sufficiently clear of the two runners to his inside causing tightening to both. Mr Goodwin showed how the two runners involved were both racing tractably prior to being tightened for room.

Mr Innes said that YELRACM had given Sam Spratt a difficult ride and inferred that both that horse and WORTHING for Craig Grylls had contributed to the incident by their racing manners.

Submissions for Penalty:

Mr Oatham said that Mr Innes did not have a bad record with 3 suspensions for careless riding in the previous 12 months. He said that while today’s incident resulted in two runners losing several lengths the Stewards considered the offending to be towards the lower end of the scale.

Ms Innes told the committee that he had made an error of judgement when he crossed over when not clear. He said that if the two horses had eased back prior then there would have been no problem.

Mr Innes was asked about his upcoming riding engagements. He confirmed that he would not be accepting rides at the Waimate meeting on Thursday September 22nd but said he would be riding at Ellerslie on September 24th.

Reasons for Penalty:

In coming to a decision on penalty the committee considered all of the submissions. We gave credit to Mr Innes for his admission of the breach and his riding record. He is a busy and in-demand rider so three suspensions in 12 months can be considered a good record. In assessing the degree of carelessness we looked at the movement of Mr Innes’s mount and the severity of the subsequent interference. Mr Innes did not come across at an acute or dangerous angle but rather misjudged his distance clear of the affected horses. Although both horses lost some ground in the incident we considered Mr Innes’s carelessness to be at the lower end. The video did not support Mr Innes’s assertions that those affected were racing ungenerously at the time of the interference.
