Facts:
Jockey S Doyle admitted a breach of Rule 638 (1)(d) in that he allowed his mount to shift inward passing the 900 metre mark when not clear of ALDERBARAN STAR which was checked.
Rule 638 (1) (d) reads – ‘A rider shall not ride a horse in a manner which the Judicial Committee considers to be careless’.
Mr Goodwin took all parties through the available films indicating where COMMETT, ridden by Mr Doyle, moved inward causing ALDERBARAN STAR (J Riddell) to be checked. He informed the committee that Mr Doyle was not sufficiently clear.
Mr Doyle agreed with Mr Goodwin’s submission.
Submissions for Penalty:
Mr Goodwin viewed the incident in midrange because Mr Riddell had to check his mount. Mr Doyle has not been charged under this rule in the last 12 months – a very good record. He was a North Island rider and highweight rider only and asked for a period of suspension of 4 – 5 days.
Mr Doyle asked for any suspension to begin after racing this coming Saturday.

In coming to the committee’s decision to impose a period of suspension the committee took into account Mr Doyle’s very good record and his admittance of the breach. The committee viewed the incident above mid-range because of the check to ALDERBARAN STAR and that horse losing ground.
