As Mr Goindasamy admitted the breach, it was deemed to be proved.

Accordingly, Mr Goindasamy’s license is suspended from the close of racing on Monday April 26th up to and including racing on Saturday May 8th, 2021. In addition, he is fined the sum of $500.
Facts:
Following the running of Race 8, (Bayleys Rural 1400), an Information was lodged by Mr Oatham alleging a breach of Rule 638 (1) (d) in that A Goindasamy (VIRTUOSA LAD) allowed his mount to shift inwards near the 1000m when not clear of PABLO ESK (F Lazet) which was checked.
Mr Oatham had Mr Goodwin demonstrate the incident by way of the video footage. Head and side-on views were shown concurrently.
Immediately prior to the incident Ms Schofer (LINCOLN HILLS) moved forward to lead the field but subsequently eased the pace. This made it difficult for runners in behind, particularly JEWEL OF PATCH (S McNab). Mr Goindasamy who was further back, and aware of the pace easing, looked to his inside. The RIU maintained that he should have held his position but instead Mr Goindasamy moved inwards and checked the mount of Ms Lazet.
Mr Goindasamy told the Committee that the pace eased quickly. He had an inexperienced Rider on his inside, and he wasn’t sure if she wanted to hold her position or drop back. He was starting to get up on the heels of the horse in front of him, so he made the decision to move inwards unaware that Ms Lazet had kicked up on the inside.
Ms Clapperton said if the pace had stayed on Mr Goindasamy would have gone with the pace, but once it eased everything jammed. Ms Lazet was not in a good position ¾ length back and Mr Goindasamy did not know if her intent was to go back or move forward.

Mr Oatham produced Mr Goindasamy’s riding record which showed 4 breaches of the Careless Riding Rule in the last 12 months.

He said the incident today had some slight mitigating factors, but this did not excuse Mr Goindasamy from shifting inwards to the extent that he did. He was never more than a bare length in front of Ms Lazet and she was almost dislodged. The Stewards described the incident as well above midrange. In relation to Mr Goindasamy’s record Mr Oatham said he was now a Senior Apprentice and the Stewards would expect better.
Mr Goindasamy had nothing to say regarding penalty. He advised of commitments through until Monday April 26th.

The Committee considered all submissions. As a result of Mr Goindasamy’s inward movement PABLO ESK suffered severe interference. The horse was forced into the running rail, lost ground and Ms Lazet was fortunate not to be dislodged. Mr Goindasamy blamed the easing of the pace, and while this was certainly the catalyst for the incident, he had the option of easing back and holding his position. Instead Mr Goindasamy elected to move inwards despite knowing that he had an inexperienced Rider somewhere to his inside. The Committee placed the overall incident as above midrange.
Today’s breach brings the number of careless riding charges to five in a 9-month period with Mr Goindasamy only just completing a period of suspension for the same breach. The Committee sees this as an aggravating factor.
Taking into account all factors, including his admission of the breach, and the Judicial Penalty Guide the Committee considers an 8-day suspension an appropriate penalty.
