Facts:
Miss M. Hudson, represented by Mr K Gray, admitted a breach of Rule 647(1) in "that as the rider of "Portrush" you failed to weigh in as required".
Submissions for Decision:
Mr Goodwin informed the committee that on returning to the birdcage Miss Hudson dismounted, spoke to both the trainer and owners of her mount Portrush and walked into the weighing area and proceeded straight to the jockeys’ room.
Miss Hudson when spoken to admitted she had just forgotten.
Mr Gray, on Miss Hudsons behalf, confirmed that it was a memory lapse on the jockeys behalf.
Submissions for Penalty:
Mr. Goodwin submitted that Miss Hudson's horse was unplaced in the race and no stake money was involved. However, he submitted that the rules of racing state clearly that all jockeys must weigh in (Rule 647(1)). He confirmed that Miss Hudson was a young rider starting to make her way in racing and has had about 50 rides in her career so far. He submitted that a fine of between $200 and $300 would be appropriate.
Mr Gray, on Miss Hudsons behalf, asked the committee to take into account her youthfulness and her relative lack of race riding experience. He felt that a monetary fine must take into account her guilty plea and her determination to ensure that this will not happen again.
Reasons for Penalty:
Miss Hudson, in coming to our decision to impose a fine for this breach, we have carefully considered previous breaches of this rule. Previous breaches of rule 647 (1) in the last 12 months according to our records have all involved a horse and rider in either a dividend bearing position or earning stake money. We have noted the penalty guide recommendation that the starting point for a breach of this rule where the rider does not finish in a dividend or stake bearing position is $300 but believe consideration must be given that although "Portrush" will be disqualified and you will lose your riding fee, the owners were not affected with a loss of stake money, and punters were not affected. It was, as you and your representative have said, a lapse of memory and one this committee is sure you will not repeat.
