Penalty:
This committee, Miss Whelan, suspends you from race riding after the completion of racing this Sunday the 16th of October until the completion of racing on Saturday the 22nd of October - 4 days.

Facts:
Apprentice jockey Miss L. Whelan admitted a breach of rule 638 (1) (d) in that as the rider of "Arizona Jazz" she allowed her mount to shift inward near the 900 metres dictating "Red Cougar" inwards into the line of "Lawrence of Arabia" which was checked. Miss Whelan was represented by trainer Mr M Breslin.
Submissions for Decision:
Mr Goodwin, using the available films, informed the committee that near the 900m mark Miss Whelan gradually came across onto the line of "Red Cougar" who moved inwards onto the line of "Lawrence of Arabia". Miss Whelan's mount was racing a little greenly but that inward movement did cause "Lawrence of Arabia" to lose its position. He believed all three horses involved in the incident were racing greenly but the two horses on Miss Whelan's inside were entitled to be where they were and although the tightening was slight two horses were affected.
Miss Whelan told the committee it was her mount's first start with blinkers and it was travelling greenly.
Mr Breslin informed the committee he agreed there was slight tightening but no contact was made and Lawrence of Arabia, the horse down on the rails, was travelling keenly and possibly over racing.
Submissions for Penalty:
Mr Goodwin told the committee that Miss Whelan had a good record under this rule. She was last charged on the 14th of May 2011 and received a 3 day suspension which was her first. He submitted the breach was in the mid to low range and asked for a suspension of 4 days. He classed Miss Whelan as a jockey who rode throughout New Zealand.
Mr Breslin asked the committee to consider that the breach was at the lower end of the scale and that there was about a 6 month gap between her first breach and the admitted breach today. He was unsure how many rides she has had in that time. He informed the committee that Miss Whelan wished any period of suspension to begin after this Sundays racing.
Miss Whelan had little to add other than to say she had had approaches from a trainer to ride on Wednesday 19th at Te Aroha. She confirmed to the Committee that no commitments to ride at that meeting were undertaken.
Reasons for Penalty:
Miss Whelan in coming to our decision to impose a period of suspension for this breach we have taken into account your admittance of the breach and your good record. We are of the opinion that the breach could be classed in the mid to low range and we accept that you are a busy national rider. However, even though your movement across was gradual and your horse was racing greenly, your actions caused tightening to the two horses down on your inside. In particular, the horse down on the rails, "Lawrence of Arabia", was dictated to by your actions. We have noted your comments about approaches to ride at Te Aroha on Wednesday and have also noted that no commitments were entered into.
