Mr P Turner, rider of MONOWAKE in Race 2 admitted a breach of Rule 530(2) (6) in that he used his whip in an excessive manner in the home straight.



Mr P Turner, rider of MONOWAKE in Race 2 admitted a breach of Rule 530(2) (6) in that he used his whip in an excessive manner in the home straight.

Stipendiary Steward Goodwin, after reading the rule, asked assistant Stipendiary Steward, Bateup to show the relevant films and comment.

Mr Bateup pointed out that the horse was struck approximately 9 times before the 200 metre mark. The films clearly showed the striking of the horse with no respite.

Mr Turner, when asked to comment stated that it was a high weight horse, the trainer told him it was lazy and that he was aware of the guidelines when striking a horse.

Mr Goodwin informed the committee that this was his second offence under this rule and that he had received a warning on 15 April 2006. Mr Turner concurred with Mr Goodwin's statement.

Mr Goodwin, in asking for a period of suspension, asked the committee to consider this was a case at the top end of the scale. The information stated ?his whip in an excessive manner? and that his record under this rule was not good.

Mr Turner asked for a fine.

DECISION AND REASON

--

The committee, in arriving at its decision to suspend Mr Turner for a breach of this rule took into account the excessive use of the whip, to which he agreed was outside the guidelines. The Committee also took into account his record under this breach which was not good. The image of racing is harmed by excessive use of the whip and his apparent belief that it was a lazy horse and only a high weight horse was no excuse for his actions.

Mr Turner was suspended from the completion of racing Saturday 15 July until the completion of racing on Saturday 22 July. A total of three riding days.
