As Mr Dye admitted the breach it was found to be proved.
Penalty:
The committee determined that Mr Dye’s jockey’s licence be suspended for 3 riding days, commencing at the conclusion of racing on 16 December 2012 up to and including racing on 22 December 2012. The three days being; Matamata 19 December, Otaki 20 December and Manawatu/ Te Rapa 22 December 2012.
Charge:
Following the running of Race 1 Information A3104 was filed by Stipendiary Steward Mr N Goodwin under Rule 638(1)(d). The information stated that Mr S Dye (Saltatio) angled his mount out near the 100m when not clear of Coercion (L Allpress) which was checked.
Mr Dye, who admitted the breach, said that he understood the charge and the rule.
Facts:
Mr Goodwin showed all available films and said Mr Dye allowed his mount to shift out when being ridden with vigour and when not clear of Coercion (L Allpress) which had to be steadied.
Mr Dye said that he was guilty and that he came out when not quite clear of the other horse, he said that the leader was shifting about a little but that that was no excuse. He added that his mount was a little green and did shift further than he anticipated, that it was not a sharp movement and that it had no bearing on the final placings.
Submissions for Penalty:
Mr Goodwin said that the careless riding was in the low-range, he submitted that a suspension of 3-4 days would be an appropriate penalty.
Mr Dye said that he had had approximately 10 raceday rides since resuming riding after a lengthy lay-off and asked that any suspension start after racing on 16 December 2012. He added that he did not intend to ride in the South Island until after 25 December 2012.
Reasons for Penalty:
The committee took into account the starting point of 5 days suspension, the admission of the breach and that the carelessness was at the very low end of the scale.
