The Committee dismissed the charge.

Facts:

Following the running of Race 4, an information was lodged by Mr R Neal alleging a breach of Rule 638(1) (d). The information alleged that passing the 1400m M Cameron permitted his mount THE MINERS SON to shift in when not clear of MR McCLOUD which was dictated inwards into the line of YANGMING which was checked.

The rule was read and Mr Cameron acknowledged he understood the rule and confirmed to the committee he did not admit the breach. He also advised that he would not be calling any witnesses.

Submissions for Decision:

Mr Neal explained that the incident they were concerned about occurred at the first turn in the race when YANGMING was checked. He called the rider of YANGMING, Mr V Colgan, as his first witness. Mr Colgan confirmed he ran out of room on that corner. He said he was racing on the inside of Mr Bradley and when Mr Bradley came across he had to take hold of YANGMING.

Mr Cameron asked Mr Colgan if YANGMING was always going to have difficulty making the first bend due to it racing keenly. Mr Colgan agreed that his mount wasn’t that happy coming up to the corner but when he took hold of his horse it reacted badly and made things look a lot worse. It was racing fiercely and throwing its head around.

Mr Bradley was the next witness called by the Stewards. He said he was in second position approaching the first bend when Mr Cameron began a move around the outside of him dictating him slightly. He said his horse McCLOUD "ran away" from Mr Cameron’s mount causing him to move onto YANGMING (V Colgan). Mr Bradley further explained that his horse put its head on the side and moved inwards as Mr Cameron came around him.

Mr Cameron asked Mr Bradley if he had crossed in front of him at any stage or if any contact had been made between the horses. Mr Bradley replied that there had been no contact; rather his horse had shied away from Mr Cameron when he came close. He also said that Mr Cameron had not crossed in front of him but had taken his line a little bit.

Mr Neal asked Mr Goodwin to show the films of the incident. He identified all the runners involved and said that Mr Cameron came across from a wide draw putting pressure on Mr Bradley’s mount which in turn moved down onto Mr Colgan’s mount which was checked back onto Mr McDonald. The films were shown at various times in slow motion and normal speed.

Mr Neal asked Mr Bradley if Mr Cameron had dictated his line of running and to reiterate why he had moved down onto Mr Colgan’s mount. Mr Bradley replied that Mr Cameron had not dictated his line of running but rather his horse was running away from Mr Cameron’s horse. He added that there was always a gap between Mr Colgan and the running rail and if Mr Colgan’s horse had been racing generously it had the option of moving closer to the rail which it did not do.

Mr Cameron put his case to the committee using the films running at both slow speed and paused at certain stages. He said he was aware of Mr Bradley to his inside (confirmed by the films showing him looking inwards) but that Mr Colgan was already in trouble from Mr Bradley’s inward movement before he (Mr Cameron) had begun to go around Mr Bradley. He pointed to Mr Colgan standing up in his irons taking a hold prior to his own movement around Mr Bradley. He concluded by saying that there was a lot of room between Mr Colgan and the running rail for YANGMING to move into but the horse was not racing generously enough at the time. He said he had always given Mr Bradley enough room. In essence Mr Cameron said the interference was a result of Mr Bradley’s mount being a "bit green" and running inwards as he (Mr Cameron) came around him and of Mr Colgan’s mount YANGMING racing ungenerously and not taking the corner.

Mr Neal summed up saying the Stewards’ contention was the interference to YANGMING was a direct result of Mr Cameron coming around the field when not clear of Mr Bradley who in turn was forced inwards onto Mr Colgan who was checked.

Reasons for Decision:

The committee had careful regard to the extensive submissions put before it by both the Stewards and Mr Cameron. Neither witness gave compelling evidence to support the Stewards’ case. Mr Colgan said Mr Bradley dictated his line of running but also that his own horse YANGMING was not 100% happy and was awkward in its attempt to take the corner. Mr Bradley said Mr Cameron did not dictate his line of running and that his own horse did not help the situation.

The films highlighted the fact that when interference occurs on a bend soon after the start it can be difficult to attribute blame to only one factor or one rider. YANGMING was the innermost runner approaching the first turn but appeared reluctant to negotiate the turn. As the rest of the field began turning it was still on a straight line. Mr Bradley’s horse moved inwards and Mr Colgan found himself in trouble. In an effort to avoid heels he tried to restrain YANGMING but it reacted unkindly and raced erratically as a result.

The Stewards’ case centred around Mr Cameron’s actions out wider on the track but we were not satisfied that he could be held accountable for the interference. His inward movement appeared to happen subsequent to the other incidents. Accordingly we were not satisfied that the charge of careless riding against Mr Cameron had been proved.
