As Mrs Allpress admitted the breach we found the charge proved.
Penalty:
Mrs Allpress advised us of riding commitments within the next 7 days therefore under Rule 1106(2) we defer her suspension until those commitments have been met. Mrs Allpress is suspended from the close of racing on Saturday September 8th up to and including racing on Thursday September 13th (4 days).
Charge:
Following the running of Race 3 an Information was lodged by Mr R Neal alleging a breach of Rule 638(1)(d) in that passing the winning post on the first occasion L Allpress permitted her mount CENTAROSE to shift in when not clear of THE PALM KING which was checked. Mr Neal read the careless riding rule and Mrs Allpress confirmed she understood the rule and that she admitted the breach.
Facts:
Mr Goodwin took the committee through the available videos. Mrs Allpress was on the outside of the field seeking a run closer to the rail. She allowed her mount CENTAROSE to shift across the track but was not the required distance clear of THE PALM KING when she did so. Mr Colgan was entitled to a clear run but his line was taken by Mrs Allpress’ actions.
Mrs Allpress explained that she had simply misjudged her distance when crossing. Initially she had stayed out wide "just ambling along" but admitted causing interference to Mr Colgan when she shifted across. She said it was not intentional and as soon as she realised there was another horse on her inside she moved off and went forward to relieve any pressure.
Submissions for Penalty:
Mr Neal said Mrs Allpress was the leading rider last season and had a good record with no charges of careless riding to date in 2012. He said Mr Colgan had been checked and had to steady his mount but he was able to maintain his position in the race despite the interference. The Stewards considered the breach to be mid-range and submitted that a period of suspension was the appropriate penalty.
Mrs Allpress asked the committee to consider she had been 9 months without incurring a suspension and that her breach today was simply an error of judgement. She advised of riding commitments up to and including next Saturday September 8th.
Reasons for Penalty:
The Judicial Committee adopted as a starting point a period of suspension of five days. We considered all of the submissions presented. Mrs Allpress has an excellent record considering the number of meetings she rides at throughout the country. The level of carelessness in this instance was, in our opinion, just below midrange. There was no doubt that Mr Colgan received a check approaching the first bend due to Mrs Allpress coming across when not quite clear of his mount however she did take remedial action once she realised her mistake and the consequences of the interference were minimal. Taking into account her admission of the breach, her record and the degree of carelessness we have reduced the penalty to one of four days.
