As Mr Elliot admitted the breach we found the charge proved.

Penalty:

Mr Oatham produced Mr Elliot’s recent riding record which showed him riding in the Central Districts at Taranaki (24/9/16) and at Woodville (11/8/16).

Mr Barlow further submitted that the Rogerson stable was sending horses to Tauherenikau next week and that Mr Elliott would have been riding there. He said Mr Elliot had commitments to ride at Avondale on Wednesday but would like any suspension to begin after that days racing.

Mr Elliot is suspended from the close of racing on Wednesday October 5th up to and including racing on October 13th.

12/10/16 - Te Aroha
13/10/16 - Woodville

Facts:

Following the running of Race 2, Mardigras Event Hire 1200m, an Information was lodged by Mr J Oatham alleging a breach of Rule 638(1)(d) in that R Elliot (FIERTE) allowed his mount to shift inwards near the 1100 metres when not clear of SABOTAGE (D Johnson) and ALWAYS READY (K McCulloch) which were crowded and checked.

Rule 638(1) (d) provides: A Rider shall not ride a horse in a manner which the Judicial Committee considers to be careless.

Mr Elliot confirmed to the Committee that he admitted the breach. Assisting him was Mr Barlow, foreman for the Rogerson Stable.

Mr Goodwin explained the incident using the available video angles. FIERTE jumped from barrier 4 and soon after the start Mr Elliot angled for a run closer to the running rail. In doing so he crossed in front of the runner to his inside when only ¾ length clear which put pressure onto SABOTAGE who in turn caused interference to ALWAYS READY closest to the running rail. Mr Goodwin said there was no pressure from any other horse to the outside of Mr Elliot.

Mr Barlow told the committee that Mr Elliott had merely made an error of judgement.

Submissions for Penalty:

In relation to penalty Mr Oatham said Mr Elliot had been riding for a little over 12 months and had a clear record. He said he was a promising young rider who was getting plenty of rides. Mr Oatham said it was commendable for a young rider, starting out, to go for such a long stretch with a clear record. The Stewards placed the degree of carelessness as midrange and submitted a suspension in the vicinity of 4 – 5 days would be appropriate.

Mr Barlow concurred with Mr Oatham’s submissions on penalty and said Mr Elliot was a busy rider.

Reasons for Penalty:

In coming to a decision on penalty the committee took into account all of the submissions presented and adopted as a starting point of a five day suspension. It was our opinion that the breach sat just above the mid-range. Mr Elliot alone was the cause of interference to two horses with the side-on view highlighting how badly ALWAYS READY in particular was affected. We applied an uplift of one day for the level and consequences of carelessness.

Mitigating factors were Mr Elliot’s ready admission of the breach and his excellent riding record – this being his first ever careless riding charge. Taking all of these factors into account it was our opinion that a four day suspension was appropriate on this occasion. The race, while being on a Premier race day, was not of black type status therefore was a neutral factor in our decision.
