As Ms Hudson admitted the breach, it was deemed to be proved.

Penalty:

Accordingly, Ms Hudson’s license is suspended from the close of racing on Sunday May 2nd up to and including racing on Wednesday May 12th – 5 days. In addition, she is fined the sum of $250.

Facts:

Following the running of Race 5, an Information was lodged by Mr Williamson alleging a breach of Rule 638 (1) (d) in that M Hudson (HYDROEXPRESS) allowed her mount to shift in over the final stages crowding NO ROCK NO POP (A Mudhoo) and ANDUIN (L Hemi).

Mr Williamson had Mr Goodwin demonstrate the incident by way of the video footage. He showed Ms Hudson riding with vigour over the concluding stages of the race. Her mount HYDROEXPRESS started to shift inwards however Ms Hudson did nothing to straighten it up even after contacting NO ROCK NO POP. Mr Goodwin acknowledged the outward movement of ANDUIN but said Ms Hudson was responsible for 90 percent of the incident. In addition, she continued to use her whip after the interference had occurred.

Ms Hudson said HYDROEXPRESS was a difficult horse to ride and should have won more races than she has but for a habit of lugging inwards. Ms Hudson said she did not see Mr Mudhoo coming up from behind and thought she had at least 2 horse widths between her and ANDUIN to move inwards safely.

Submissions for Penalty:

Mr Williamson produced Ms Hudson’s riding record which was clear. The Stewards placed the carelessness as at least midrange with Ms Hudson displaying a “win at all costs” mentality. There were multiple protests because of the interference and some chance that both 3rd and 2nd placed horses could have won the race, although there was no certainty around that.

Ms Hudson said she has been riding for 10 years and this is only her second charge in that time. She has a family and her only income is as a Trackwork Rider and Licensed Jockey.

Reasons for Penalty:

The Committee considered all submissions. We placed Ms Hudson’s degree of carelessness as above midrange. She continued to ride her mount out with the whip with no correction to its line of running. This despite Ms Hudson being familiar with the horse and aware of its tendency to run inwards. The incident resulted in the lodging of two protests following the race and although both were subsequently dismissed both had merit.

We adopted a starting point of 6 days suspension and $500 but afforded her some credit for an excellent record with this being only her 2nd charge in a 10-year career.
