As Mr Allan admitted the breach we found the charge proved.

Penalty:

Mr Allan’s license is suspended from the close of racing on Saturday March 3rd up to and including racing on Monday March 12th.

Facts:

Following the running of Race 1(Stella Artois 1300) an Information was lodged by Mr N Goodwin alleging a breach of Rule 638(1) (d) in that T Allan permitted his mount STRUT to shift inwards passing the 1000m when not sufficiently clear of ABRAHAMS which was checked.

Rule 638(1) (d) provides: A Rider shall not ride a horse in a manner which the Judicial Committee considers to be careless.

Mr Allan confirmed to the Committee that he understood the charge and that he admitted the breach.

Mr Goodwin had Mr Oatham outline the incident using all the available films. He identified all the runners and highlighted Mr Allan racing wide on the track. While attempting to gain a position closer to the rail Mr Allan moved inwards when only 1 ¼ lengths clear of Mr Coleman who was forced to restrain his mount, in order to avoid clipping the heels of Mr Allan’s mount. Mr Oatham added that as Mr Allan moved inwards he also eased up slightly which didn’t help the situation. Mr Oatham said that Mr Coleman told the stewards his horse had over-reacted when he restrained it.

Mr Allan said Mr Coleman was a good rider and was probably entitled to be where he was. He agreed with the Stewards that Mr Coleman’s mount over-reacted to being restrained.

Submissions for Penalty:

Mr Goodwin said this was Mr Allan’s first charge of careless riding since his return to race riding following a long break. The Stewards placed his degree of carelessness in the low range.

Mr Allan said he had 12 years away from race riding and returned to ride in May 2017. He said his only riding engagements within the next seven days were on Saturday March 3rd but asked if he could be back riding for the Wellington meeting on March 10th.

Reasons for Penalty:

The Committee placed Mr Allan’s degree of carelessness in the low range. When he moved inwards in front of Mr Coleman he was 1 ¼ lengths clear of that runner. This is just short of the required 2 lengths clear. Mr Coleman restrained his mount to avoid clipping heels but as he did so his horse clearly reacted in an exaggerated manner which made Mr Allan’s carelessness look worse than it actually was. We adopted a starting point of six days as outlined in the Penalty Guide for Judicial Committees. We note that Mr Allan has had 137 rides to date in the 2017/18 season (NZTR Jockeys profiles), and this is his first careless riding charge. We consider this a very good record and have allowed a one day discount for this combined with his admission of the breach.

There were no aggravating factors.

An appropriate penalty is a suspension of five days.
