Following the running of Race 8 Mr. B.Hibberd lodged an information instigating a protest pursuant to the Rules of Racing alleging that King Kalani or its rider placed 1st by the judge interfered with the chances of Sir Ambrose placed 3rd by the judge



Following the running of Race 8 Mr. B.Hibberd lodged an information instigating a protest pursuant to the Rules of Racing alleging that King Kalani or its rider placed 1st by the judge interfered with the chances of Sir Ambrose placed 3rd by the judge ? the interference occurred on the final bend.

The Judge's placings were, first No 8 King Kalani, second No 1 Go Thenaki, third No 5 Sir Ambrose and fourth No 4, Daniel Samson.

The margins were a neck and one length.

--

The information was filed with the registrar within the time prescribed.

Present during the hearing were Mr. Hannam, rider of King Kalani, Mr. Greg Lambert, trainer of King Kalani and Mr. B.Hibberd rider of Sir Ambrose. (Mr. Marr, the trainer of Sir Ambrose attended the delivering of the decision only.)

Mr. Hibberd began by showing the available films of the race as the horses rounded the home bend into the straight. He showed Mr. Hannam racing on his outside and alleged that as they rounded the corner Mr.Hannam allowed his mount, King Kalani, to roll inwards closing a gap that Mr Hibberd was about to take. He said that as a result he lost a couple of lengths of momentum which he believed cost him two lengths at the finish. He also mentioned that Ms Myers who was racing on his inside may have moved out a little.

Mr. Hannam also used the films to state his case to the committee. He maintained that he kept his line all the way around the bend and any interference to Mr. Hibberd was caused by Ms Myers rolling out from her position on the inside of Sir Ambrose.

Mr. Goodwin, stipendiary steward, was asked to make submissions and he said that it was his opinion that Ms Myers had been partly responsible for the incident.

Decision

--

Rule 876 (1) requires us to ask first whether interference occurred and then, if so, whether that interference has cost the horse interfered with a chance of finishing in a better position.

--

We are satisfied having viewed the films and listening to the evidence that some interference has occurred. In this situation Mr.Hibberd, on rounding the bend for home has had to check his horse out of gap that closed in front of him.

--

We are not satisfied however that King Kalani (R.Hannam) was entirely to blame. There is sufficient evidence pointing to a contributing movement outwards from the horse on the inside of Mr. Hibberd ridden by Ms Myers.

For these reasons the protest is dismissed and placings are allowed to stand as called by the Judge.
