As the charge was admitted, the Committee deem the charge to be proved.

Penalty:

Taking into account Ms Andrew’s desire to defer the commencement of a suspension in order to fulfil commitments at Otaki, she is suspended from the conclusion of racing on Monday 6 January until the conclusion of racing on Wednesday 15 January 2020.

Facts:

Following the running of Race 7 (NZB Insurance Pearl Series Race), Information A11632 was filed with the Judicial Committee. It alleged a breach of Rule 638(1)(d), in that : “...Holly Andrew (VROOM) allowed her mount to shift inwards in the home straight tightening BALL GOWN (D Bradley) and ALEXANDRITE (L Allpress)”.

Rule 638(1)(d) states:
“A Rider shall not ride a horse in a manner which the Judicial Committee considers to be: ... (d) careless.”

Ms Andrew confirmed that she understood the Rule and admitted the breach.

Using the head-on, side-on and rear-view films Mr N Goodwin identified Ms Andrew on VROOM with Mr Bradley (BALL GOWN) to her inside and Mrs Allpress (ALEXANDRITE) inside of Mr Bradley. He described VROOM laying-in in the home straight with Ms Andrew doing very little to counteract that action. She had moved some five to six horse widths while still pushing and using her whip, and in the process had caused tightening to Mr Bradley and Mrs Allpress. Mr Goodwin submitted that while there had been tightening, those runners were not required to check as a result.

Ms Andrew had no comments to make regarding the films or Mr Goodwin’s interpretation.

Submissions for Penalty:

For the RIU, Mr Balcombe submitted that Ms Andrew had a clear record under the Rule, and had 347 rides within the previous 12 months period. He believed the carelessness was below mid-range as the carelessness had not cost either rider a higher placing.

Ms Andrew advised that she did not realise her movement was as severe as it was until she had seen the films. She said she was apologetic about her actions and added that she thought she was going to win, but again was not aware of how much she actually moved at the time. She also indicated that she had upcoming riding commitments at Otaki on 6 January.

Reasons for Penalty:

The Committee considered all of the submissions placed before it. The head-on film clearly shows that Ms Andrews had moved inwards from an original position that was much wider on the track. She clearly took some time, including by her own admission, to realise the full extent of her movement. While she was over exuberant at the prospect of winning the race, her actions have caused tightening to BALL GOWN and ALEXANDRITE over the concluding stages.

We observe from the head-on film that she tended to take some action to correct her movement over the concluding stages, but by that stage the tightening to the other runners had already taken place. We have independently assessed the level of carelessness to fall within the mid-range and adopt the JCA Penalty Guide starting point for mid-range carelessness of an 8 days period of suspension.

When we consider her excellent record and her admission of the breach, the end result will be a seven day period of suspension.
