Ms Myers indicated to the committee that she understood Rule 638 (1)(d), and that she admitted the breach.
Using the films, Mr Goodwin identified the runners concerned: SLICE OF CLASS (R Myers) and INDOLLJENCE (S Doyle). SLICE OF CLASS commenced to race greenly in the home straight and shifted in abruptly when Ms Myers went to use the whip. Ms Myers took corrective action in straightening her mount at this point. However, shortly afterwards when ridden with vigour near the 100 metres mark SLICE OF CLASS shifted into the line of INDOLLJENCE which was subsequently checked. The stewards believed that Ms Myers could have done more to straighten her mount on the second occasion and avoid the check to Mr Doyle.
Ms Myers stated that her horse was racing quite greenly down the home straight and that when she allowed her mount to roll in, it moved in quite abruptly and she simply was not aware that Mr Doyle was still to her inside. It was only when Mr Doyle called to her that she was aware he was still there, and at that point the damage had already been done.

Mr Goodwin submitted that Ms Myers is a leading rider in the Central Districts who received a number of rides. She had received three (3) periods of suspension during the last 12 months. Her most recent period of suspension was for four (4) days on 18 December 2013 at Matamata. Mr Goodwin identified Ms Myers as a busy rider who did not frequent the judicial room often. The stewards placed the level of carelessness within the mid-range and submitted a five (5) day period of suspension as appropriate.
Ms Myers advised the committee that she had intended to ride at Rotorua (6 January) and Reefton (8 January), but as declarations for those meetings had not closed, she had made contact with trainers Trent Busuttin, Darrell Hollinshead and Kevin Myers and she no longer had engagements for those meetings. Accordingly, she advised any period of suspension could commence after the Otaki meeting on 5 January. She submitted the carelessness occurred close to the post and in hindsight she would have taken corrective action if she knew Mr Doyle was there.
Mr Goodwin also stated that the connections of INDOLLJENCE did consider lodging a protest but decided not to proceed with such action.
Reasons for Penalty:
The committee had regard to all of the submissions put before it. While Ms Myers’ mount had got the better measure of INDOLLJENCE, the carelessness did result in undue interference to Mr Doyle. It was clear that SLICE OF CLASS was racing greenly down the home straight and that Ms Myers did take corrective action in an attempt to straighten in the run home. However, near the 100 metres she allowed her mount to move inwards as she was not aware that Mr Doyle was located to her inside. She had an obligation to be aware of her immediate surroundings and take corrective action at this point; she failed to do either. It was our opinion that a period of suspension was an appropriate penalty on this occasion, and we adopted a starting point of five (5) days. We were also satisfied, based on the information placed before us, that any period of suspension can commence after racing at Otaki on 5 January. In terms of mitigation, the committee took into consideration Ms Myer’s early admittance of the breach and her good judicial record for a very busy rider. We also independently assess the level of carelessness to be at below the mid-range. On balance, the mitigating factors, in our view, reduced the five (5) day starting point by a quantum of one (1) day.
