--Following the running of Race 1, the More FM Maiden 2YO, Mr. G. Vile lodged a protest under Rule 642 (1) alleging that APHELION or its rider placed 3rd by the judge caused interference to OUR CENTREFOLD placed 4th by the judge. The interference occurred in the final straight.

--Following the running of Race 1, the More FM Maiden 2YO, Mr. G. Vile lodged a protest under Rule 642 (1) alleging that APHELION or its rider placed 3rd by the judge caused interference to OUR CENTREFOLD placed 4th by the judge. The interference occurred in the final straight.
--The Judge’s placings were:
--1st No. 3 SHE’S A COUGAR
2nd No. 1 SAINT AGATA
3rd No. 4 APHELION
4th No. 2 OUR CENTREFOLD
5th No. 7 VITAL CHOICE
The margin between third and fourth placed horses was a half head.
--The information was filed with the registrar within the time prescribed.
--Representing OUR CENTREFOLD were trainer G. Vile and rider Ms R. Myers and for APHELION were trainer G. Barlow and rider J. Waddell.
--Mr. Vile showed the head-on and side-on videos of the final stages of the race where APHELION, when racing up against the running rail, veered out sharply into the line of OUR CENTREFOLD. Ms Myers who was riding OUR CENTREFOLD was forced to stop riding for a stride and change ground towards the inside. From there she finished on strongly gaining ground on APHELION.
--Mr. Vile said had the margin between the two horses been as length or more he would not have lodged a protest but as Ms Myers was beaten by a half head he believed that she had been denied third placing.
--Ms Myers confirmed that she had been forced to take hold of her mount and change ground and that she was “taking ground” off APHELION.
--Using the head-on video and the mowing strips as a guide Mr. Waddell queried whether Ms Myers did have to change ground. He said that when his horse ducked out sharply he was well clear of her. While agreeing that OUR CENTREFOLD was finishing the race strongly he said that he was forced to stop riding to straighten APHELION so was equally disadvantaged.
--For the Stewards Mr. Goodwin said that because Ms Myers missed a stride due to APHELION moving outwards the chances of OUR CENTREFOLD finishing in third placing were affected.
--Decision
--Rule 642(1) states:
--If a placed horse or its Rider causes interference within the meaning of this Rule 642 to another placed horse, and the Judicial Committee is of the opinion that the horse interfered with would have finished ahead of the first mentioned horse had such interference not occurred, they may place the first mentioned horse immediately after the horse interfered with.
--The committee considered all of the submissions including the available videos. There was no doubt that APHELION, when racing closest to the running rail, suddenly ran outwards across the line of OUR CENTREFOLD. We had to consider firstly whether or not that movement outwards did constitute interference to Ms. Myers.
--While Mr. Waddell maintained that he was clear of OUR CENTREFOLD his movement outwards was a sudden and dramatic one and Ms Myers said that she had to change ground as a result. The videos confirmed that she momentarily stopped riding and angled her mount inwards therefore we were satisfied that interference did occur.
--Secondly we had to consider whether or not OUR CENTREFOLD would have beaten APHELION had the interference not happened. While the amount of ground that she was forced to move may be considered slight of most significance was how fast Ms Myers was finishing and gaining ground on APHELION.
--Taking into account the vital stage of the race that the incident occurred and the official margin between the two horses of half a head it was the opinion of the committee that had OUR CENTREFOLD been allowed an unimpeded run to the line it would have beaten APHELION.
--Accordingly the protest was upheld and placings changed to:

4 APHELION
