Accordingly, the protest was dismissed and placing allowed to stand as called by the judge.

Dividends were directed to be paid accordingly.

Facts:

Following Race 4, Awesum Organics 1200, a protest was lodged pursuant to Rule 642(1) by Mr O Bosson alleging that horse number 10 (TWENTY ONE TIMES) or its rider placed 1st by the Judge interfered with the chances of horse number 2 (MORE THAN FAST), placed 2nd by the Judge.

The information alleged interference over the final stages.
Judges placings were:
1st - TWENTY ONE TIMES (10)
2nd - MORE THAN FAST (2)
3rd - OUR GIRL MADI (8)
4th - BELLONTHEROCKS (5)
5th - RED SHEERAN (1)

The official margin between first and second placed horses was a short head.

Submissions for Decision:

All three available films (head-on, side and rear views) of the final stages of the race were shown with Stipendiary Steward, Mr Balcombe identifying the horses involved.

Mr Bosson used the head-on film to show where, about the 100m mark, he was racing up on the outside of Mr Innes’ mount and thought he was about to run past him. At that point Mr Innes’ mount moved outwards and took his line of running. He informed the committee that he had to stop riding for approximately half a stride. He said his horse was travelling well and the loss of momentum cost him the race.

Mr Taylor agreed with Mr Bosson’s summation of the incident. He said that Mr Innes’ mount had intimidated Mr Bosson’s mount outwards and taking into account the margin of a short head it possibly cost him the race.

Mr Innes admitted his horse moved outwards but said it shied at an orange marker to his inside. He said Mr Bosson did not have to stop riding his horse out and he did not believe there was a rule that said intimidation could call for a change of placings.

For the Stewards, Mr Oatham said the protest had some merit. It was clear that interference occurred when TWENTY ONE TIMES shifted out but he said Mr Bosson’s riding style was not altered to any degree by the incident. Mr Oatham said that although Mr Bosson’s mount was finishing well the Committee had to be certain that had the interference not occurred Mr Bosson (MORE THAN FAST) would have beaten Mr Innes (TWENTY ONE TIMES).

Reasons for Decision:

Rule 642(1) states:
If a placed horse or its Rider causes interference within the meaning of this Rule 642 to another placed horse, and the Judicial Committee is of the opinion that the horse so interfered with would have finished ahead of the first mentioned horse had such interference not
occurred, they may place the first mentioned horse immediately after the horse interfered
with.

Rule 641 requires us in the first instance to determine if interference occurred. The head on film confirmed that some interference occurred as a result of Mr Innes’ mount moving outwards and taking the line of Mr Bosson’s mount. While there was no physical contact between the runners Mr Innes’ mount did dictate Mr Bosson out wider for a few strides. Mr Bosson said he had to stop riding but if so, it was only for half a stride. The Committee believes the interference was minor and had little effect on the finish.

Taking into account the margin at the finish and the manner in which both horses ran to the line we were not satisfied that MORE THAN FAST would have finished ahead of TWENTY ONE TIMES had the interference not occurred.
