Decision:
As Mr Bosson admitted the breach of the Rule the charge is found proved.
Penalty:
Accordingly we fined Mr Bosson the sum of $350.
Facts:
An Information was lodged by Mr J Oatham alleging a breach of Rule 330(3) (c) in that O Bosson failed to make the required weight for MISS DOHERTY (R1) and HEART OF COURAGE (R2).
Rule 330(3)(c) states:
A Rider shall not:
(c) fail to ride a horse at the weight at which it is handicapped to carry
Mr Bosson said he understood the nature of the charge and confirmed that he admitted breach.
Mr Oatham told the Committee he received a phone call at 7am this morning from trainer Mr Jamie Richards advising him that Mr Bosson could not make the weight for his horse, MISS DOHERTY, in race 1. Mr Oatham said Mr Bosson was 1kg overweight for that ride and also for his next ride, HEART OF COURAGE, in race 2. He had been replaced by Mrs Allpress in the first race and Mr Matt Cameron in the second.
Submissions for Penalty:
Mr Oatham advised that this was Mr Bosson’s third breach in a short period of time following a $100 fine at Waikato on March 1st and a $200 fine at Counties on March 22nd. The stewards’ submission was for a fine in the vicinity of $300 - $400.
Mr Bosson explained he had been in the sauna at 4:30am but had a plane to catch to the races at 6:30am. As soon as he realised he would not be able to make the weight of 56kgs he advised the connections of the horses. Mr Bosson said he had been struggling with his weight recently due to two suspensions keeping him away from race day riding. He also admitted that a lack of communication between himself and his riding agent Mr A Rodley did not help.
Reasons for Penalty:
Today’s breach fell short of the 120 day reset period which is the reason it was placed before the Judicial Committee. We considered all of the submissions and took into account the fact that Mr Bosson was able to be replaced by two senior riders in Mrs Allpress and Mr Cameron. He also advised the connections as soon as possible. In assessing an appropriate penalty we had regard to other breaches of Rule 330 (3) (c) with similar circumstances. Mr McNab was fined the sum of $300 at Otaki for a third breach of the rule but on that occasion had been overweight for only one horse. Mr Bosson has been replaced on two horses today.
