Following Race 8 an information was lodged by the Stewards alleging a breach of Rule 638(2) in that S Spratt made a celebratory gesture prior to the finish.
Facts:
Mr Neal told the committee that one stride short of the finish post Ms Spratt, riding MUFUSA, raised her whip in a celebratory gesture.
Submissions for Penalty:
Mr Neal said the breach was at the lower end of the scale as it was just one stride prior to the post and Ms Spratt simply made an error of judgement however it was a Group 1 race. He said she had no previous breaches of this rule and recent penalties for other riders had ranged from $100 to $300 fines.
Ms Spratt told the committee, at the time, she thought she was past the post when she waved her whip.

In coming to a decsion on penalty the committee took into account Ms Spratt's clear record under this rule, her admission of the breach and the nature of the celebratory gesture itself. Whilst we agreed that the breach was at the lower end we were mindful of the fact that this was a Group 1 race.
