This was a protest lodged by Ms R. Myers alleging that Spare A Fortune or its rider placed first by the judge interfered with the chances of No Cash placed second by the judge. The interference occurred in the final straight.

The judge’s placings were:

1st    Spare A Fortune   (No.1)

2nd    No Cash              (No.4)

3rd    All In Tempo       (No.5)

4th    Alagant Satin       (No.2)

--

5th    Balaq                   (No.7)

The official margin between the 1st and 2nd horses was half a head.

SUBMISSIONS:

Stipendiary Steward Mr Goodwin began by identifying the horses on the head-on video followed by Ms Myers explaining why she had lodged the protest.

She said that as she turned the bend for home she was waiting for a gap to appear in front of her when Ms Collett, riding Spare A Fortune, hooked outwards and took her anticipated line of running.  She said that as a result she was forced to ease her mount slightly and “go looking” for another run.

Mr Nelson said that his concern was that Spare A Fortune took the gap that should have been available for No Cash.

--

Ms Collett told the committee the she was racing on the heels of All In Tempo and looking to improve her position around him when that horse moved outwards. As a result she was forced wider out on the track and into the path of No Cash who was also looking to improve.

Mrs Hennessy used the rear view to confirm the outward movement of All In Tempo which she said caused Spare A Fortune to move into the line of No Cash.

For the stewards Mr George said that there was not sufficient room for Ms Myers to “take ownership” of the run that she believed she was entitled to. While Spare a Fortune had moved outwards another horse, Alagant Satin, had at the same time moved inwards while under pressure which contributed to the incident.  He said the Stewards would not support a change in placings.

DECISION and REASONS:

The committee carefully considered all of the submissions and viewed the available films in detail.

--

The incident that Ms Myers was concerned about took place at the stage of the race where the field had just turned for home and all riders were trying hard to win the race. Both Ms Myers and Ms Collett found themselves on horses full of running searching for a way through the field.  Ms Myers tried to push No Cash through a marginal gap which then closed in front of her caused in part by Spare A Fortune moving outwards. Spare A Fortune went on to win the race with No Cash finishing second by half a head.

The films clearly showed No Cash having to change ground when Spare A Fortune moved outwards however the committee was of the opinion that this movement was accentuated by All In Tempo moving outwards. At the same time Alagant Satin moved inwards which contributed to the gap closing in front of Ms Myers.

While No Cash did suffer some interference this was not caused entirely by Spare A Fortune.  Ms Myers was anticipating a gap opening up and was urging No Cash forward however movement from other horses contributed to the incident she complained of.

The protest was therefore dismissed and placings allowed to stand as called by the judge.
