Decision:

As Mrs Allpress admitted the breach the charge of careless riding was deemed to be proved.

Penalty:

Taking in to account the riding commitments of Mrs Allpress she is suspended from the close of racing on Saturday September 3rd up to and including racing on Sunday September 11th.

Charge:

Following the running of Race 1 an Information was lodged by Mr C George against Mrs L Allpress alleging a breach of Rule 638(1) (d).The Information stated that near the 800m L Allpress permitted her mount SCARLET O’HARA to shift in when not clear of GOLDEN GLOBE which was tightened and checked. Also affected in this incident were QUEEN BOUDICCA and WAINUI PRINCE.

Facts:

Mr George asked Mr Goodwin to explain the incident by way of the video footage. Mr Goodwin identified the riders involved and said that nearing the end of the back straight Mrs Allpress moved in towards the running rail when not sufficiently clear of Ms S Collett to her inside. Ms Collett was forced to take hold of her mount which led to two horses in behind her having to steady abruptly and move outwards.

Submissions for Penalty:

Mr George said that the interference was in the low to mid range. It was a split second decision and if Mrs Allpress had been another half length clear the incident would not have occurred. He produced her riding record which showed one suspension in July this year where a four day suspension was imposed for careless riding at Hawera. The stewards’ submission for penalty was for a period of suspension of between four and six days.
Mrs Allpress said that the incident was a simple lack of judgement on her part. She thought that Ms Collett had eased her mount back sufficiently so that she was clear to move across. When Ms Collett called out to her the damage had already been done. Mrs Allpress indicated to the committee that she had riding engagements up to and including Saturday September 3rd.

Reasons for Penalty:

In coming to a decision on penalty we considered all of the submissions. We took into account Mrs Allpress admission of the breach, her riding record and the degree of interference that she caused. Her movement inwards was a gradual one and the committee accepts that her level of carelessness was toward the lower end however the consequences were reasonably severe in that three horses were affected. It was our opinion that a suspension be imposed and we adopted a starting point of 5 days. Mrs Allpress would be one of the busiest riders in the country and to have incurred only one suspension this year is significant. We have therefore given her considerable credit for her excellent riding record. Balancing all of these factors we imposed a suspension of four riding days.
