Facts:

K Smith, the rider of Diana, admitted a breach of rule 638 (1) (d) in that he allowed his mount to shift in passing the 100 metre mark when not clear of Cash Kingdom who was checked.

Mr Goodwin using the available filmed pointed out to the committee the inward movement by Mr Smith's mount onto Cash Kingdom (C Lammas) causing that jockey to take hold. He submitted that the charge could be classed in the low to mid range.

Mr Smith informed the committee he thought he was 1 ½ lengths clear when he moved inwards and was unaware how close to Mr C Lammas’ mount he was. It was, he believed, his error of judgement.

Submissions for Penalty:

Mr Neal submitted that Mr Smith was a north island rider who only occasionally rode in the south island and could be classed as a busy rider. He has had two suspension under this rule in the last 12 months – 16th of April 2011 and 16th of October 2010.

Mr Neal reiterated again he believed the offence could be classed in the low to mid range.

Mr Smith confirmed his record under this rule.

In coming to our decision to impose a period of suspension for this breach, we have taken into account your record and your admittance of the breach. While the breach could be classed in the low to mid range, a horse and it's rider were placed into difficulty by your actions.
