CHARGES:
--This was a protest lodged by Chief Stipendiary Steward Mr Cameron George alleging that Platinum Princess or its rider placed 3rd by the judge caused interference to Golden Destination placed 5th by the Judge.
--The interference occurred in the home straight.

FACTS:
--The judge’s placings were:
--1st (6) Walk Away
--2nd (4) Red Mafia
--3rd (10) Platinum Princess
--4th (15) Miss Danni
--5th (13) Golden Destination
--6th (14) Irish Rose
--The official margins were: nose, 1/2 head, 11/2 lengths, ¾ length, 1 length

SUBMISSIONS:
--Mr George showed head-on, side-on and rear views of the final stages of the race. At the 300 metres Ms Myers was racing in behind two horses waiting for a marginal gap between them to widen. The gap that she was anticipating closed so she angled Platinum Princess inwards on a sharp angle looking for a clear run but in doing so severely checked Golden Destination.
--There was 1 ½ lengths between the 3rd and 4th placed horses and ¾ length between 4th and 5th so Golden Destination crossed the line 2 ¼ lengths behind Platinum Princess.

Mr George asked the committee to compare that with the amount of ground lost by Golden Destination as a result of the interference. He said the protest was worthy of consideration.

Mrs Allpress, the rider of the affected horse said that she had levelled up to Platinum Princess and was making a good run when suddenly Ms Myers moved inwards, made contact and stopped her in her tracks. She recovered from the interference to battle on to the finish. It was her opinion that if the interference had not occurred she would have definitely run 3rd or 4th.

Mr Coles said that the films were quite clear and that Golden Destination had lost 3 – 4 lengths of ground.
--Ms Myers admitted causing severe interference to Golden Destination but did not believe her horse should be relegated because she said she lost just as much ground in the incident. She had been held up for a run behind Mr Ormsby and was forced to angle inwards looking for clear room.

Ms Latta confirmed what Ms Myers had said and added that 2 ¼ lengths was a long margin.

DECISION and REASONS:
--The committee carefully considered all of the submissions and viewed the available films in detail. There was no doubt that Golden Destination suffered serious interference as a result of Ms Myers sudden movement inwards. Mrs Allpress lost considerable ground and momentum as the two horses made contact.
----
Of significance to the committee was the stage of the race that the incident happened and the manner in which Golden Destination finished the race. Just prior to the incident Mrs Allpress was starting to make a run but was not gaining ground quickly. After contact was made and after recovering from the incident Golden Destination did not make up a large amount of ground despite having approximately 200 metres to do so. Mrs Allpress said that she “battled away” to the finish. Ms Myers although the cause of the interference had also suffered a loss of momentum in the incident but was finishing strongly.

The committee had to be absolutely sure that had the interference not occurred then Golden Destination would have beaten Platinum Princess.
----
The protest had a lot of merit due to the degree of interference suffered however the total margin of 2 ¼ lengths between the two horses at the finish was significant and the committee was left with some doubt that Golden Destination would have beaten Platinum Princess.
----
The protest was therefore dismissed and placings allowed to stand as called by the judge.
