As Mr Hutchings admitted the breach the charge was found proved.
Penalty:
Mr Hutchings was suspended from the close of racing on Sunday October 2nd up to, and including, racing on Saturday October 15th.
Charge:
Following the running of Race 5, an Information was lodged by Mr C George alleging a breach of Rule 638(1) (d) in that rider R Hutchings allowed his mount AFFAIROFTHEHEART to shift out near the 400m when not clear of CROCODILE CANYON which was checked and NEVERSAYNEVER which was tightened.
Facts:
Mr George used the available videos to highlight the incident to the committee. On rounding the home turn Mr Hutchings was back in the field with CROCODILE CANYON directly to his outside and NEVERSAYNEVER one further out. Seeking racing room Mr Hutchings angled his mount outwards checking CROCODILE CANYON and forcing that horse out causing tightening to NEVERSAYNEVER.
Submissions for Penalty:
Mr George produced Mr Hutching’s riding record which showed two previous careless riding charges incurred in July of this year. He received 4 day suspensions for each of theses breaches. Mr George rated the interference as in the medium to high range. He said that the severity of the interference basically ended CROCODILE CANYON’S opportunity in the race and its chances were extinguished as a result.
Given these circumstances he submitted that a suspension in the vicinity of five to seven days be imposed.
Mr Richardson said that while Mr Hutchings had admitted the breach the horse in front of him at the time of the incident may have contributed and made the interference look worse.
Reasons for Penalty:
In coming to a decision on penalty the committee took into account all of the submissions. We adopted as a starting point a suspension of five days and considered the only mitigating factor was Mr Hutchings admission of the breach.
Aggravating factors were the severity of the interference suffered by CROCODILE CANYON and the sustained nature of the incident. This was not a momentary lapse of judgement as Mr Hutchings went from being in a position near the fence on the home turn to being six or seven wide. CROCODILE CANYON and NEVERSAYNEVER were carted wide for some distance as Mr Hutchings threw caution to the wind in an effort to obtain a clear run for his horse. CROCODILE CANYON was severely buffeted and almost turned sideways as a result.
It was our opinion that an appropriate penalty was a seven day suspension. Mr Hutchings was asked of his riding commitments over the next seven days. He advised the committee that he had no commitments past Sunday and that he did not ride in the South Island.
