As Ms Johnson admitted the breach we found the charge proved.

Facts:
Following the running of Race 2, the Animal Therapeutics Australia Sprint 1400m, an Information was lodged by Mr L Tidmarsh alleging a breach of Rule 638(1) (d) in that V Johnson (JACKS POINT) allowed her mount to shift inwards over the final stages hampering FAIRWAY WISH (N Teeluck) near the finish.
Rule 638(1) (d), the careless riding rule, was read with Ms Johnson confirming she admitted the breach. Mr Tidmarsh then proceeded to outline the incident using the available videos.
Just prior to the finish post at approximately the 35m mark Ms Johnson was in the lead and riding vigorously. She allowed her mount to shift inwards about one horse width forcing Mr Teeluck who was on the rail to check. Ms Johnson won the race and Mr Teeluck ran fourth.
Ms Johnson accepted the facts as outlined by the stewards and had nothing further to add.
Submissions for Penalty:
Mr Tidmarsh said the stewards believed the breach was in the low range. While Mr Teeluck did suffer some interference they did not believe it cost him a placing as two other horses were finishing quickly down the outside. Ms Johnson’s record showed one careless riding charge in April last year. Mr Tidmarsh submitted that a four day suspension was an appropriate penalty and informed the committee that Ms Johnson rode in both North and South Islands.
Ms Johnson did not wish to make any submissions on penalty. She advised the committee that she had no upcoming riding commitments and any possible suspension could begin immediately.
Reasons for Penalty:
The committee took into account all of the submissions and approached a five day suspension as a starting point for penalty. We could not identify any aggravating factors against Ms Johnson however there were several factors which leaned us towards a reduction from the standard five day penalty. Ms Johnson admitted the breach and her excellent record of a single careless riding charge in 12 months must be reflected in any penalty imposed. After viewing the films it was our opinion that the degree of carelessness displayed was at the very low end. Due to the close proximity of the winning post Ms Johnson was riding vigorously and her inward movement was slight. The chances of Mr Teeluck’s mount running into a dividend bearing position were not affected and it could be argued that Mr Teeluck actually moved slightly off the rail at the same time. Accordingly we imposed a three day suspension.
