 Accordingly Mr Hannam is fined the sum of $150.

Facts:

Following Race 2, the Animal Therapeutics Australia Sprint, an information was lodged by the Stewards alleging a breach of Rule 638(3) (b) in that R Hannam (GENDARME) used his whip excessively prior to the 200 metres.

Mr Hannam began to use the whip as the field rounded the bend into the home straight. Mr Tidmarsh played the video in slow motion and counted the number of strikes from that point up until the 200m mark. Mr Hannam could be seen to hit his mount 10 times consecutively.

Mr Hannam had no comment to make on Mr Tidmarsh’s interpretation of the films.

Submissions for Penalty:

Mr Tidmarsh presented Mr Hannam’s riding record in regard to excessive use of the whip. On July 6th 2013 Mr Hannam was fined $150 and then on July 27th he faced two charges of excessive use on the same day. He was fined $350 for the first breach and suspended for 3 days for the second.

Mr Hannam enquired as to whether his record was “reset” after a certain time period but the committee explained that this rule was not one covered by the minor infringement schedule.

Reasons for Penalty:

The guidelines for whip use in New Zealand are well recognised and understood by riders. Prior to the 200 metres they are only permitted to use the whip for six strides and then they must ride hands and heels for six strides. Mr Hannam used the whip 10 times in succession prior to the 200 metres which is four times too many. While it is never acceptable to use the whip excessively the committee considered today’s breach to lie at the lower end. Taking into account Mr Hannam's admission of the breach, his record, the large number of rides he has, and other recent penalties we imposed a fine of $150.
