An information was filed following the running of race No 8 the informant was Mr T W Taumanu and the defendant Mr B M Mangos. The information alleged that horseman Mr B Mamgos drove Flying Spender carelessly

An information was filed following the running of race No 8 the informant was Mr T W Taumanu and the defendant Mr B M Mangos. The information alleged that horseman Mr B Mamgos drove Flying Spender carelessly causing interference to Farid, driven by Mr A Neal racing towards the first bend after the start.

Mr Mangos did not admit the breach and was present at the hearing. Also present was Mr A Neal the driver of Farid.

Mr Taumanu showed the video of this incident and asked Mr Muirhead to identify the horses concerned, this video was clear that Mr Mangos was racing on the outside of Farid and had approximately a neck advantage over Farid and was attempting to ease Farid down to the rail.

Farid as shown on the video had reacted to this easing down and hung out. Mr Mangos had got his wheel momentarily caught and when he cleared this, touched the legs of Farid causing Farid to break stride momentarily. Mr Neal when questioned stated that Farid had panicked when eased down and had hung outwards. Mr Neal admitted that Farid is not the most tractable horse in a situation like this . Mr Neal also acknowledged that the move of Mr Mangos was within the rules of easing down. Mr Neal also acknowledged that another horse would probably not have reacted in this manner. Mr Mangos gave evidence and stated it was normal procedure to ease a horse down if you had the advantage as he considered he had over Farid with Flying Spender, Mr Mangos referred to the easing down regulations and stated he had the advantage and was entitled to ease Farid down to the rail. Mr Mangos was adamant it was the reaction of Farid which had contributed to this horse breaking stride.

Decision And Reasons.

Having viewed the video of this incident and listened intently to all evidence as presented by Mr Taumanu, Mr Muirhead , Mr Neal and Mr Mangos this Judicial Committee finds that the racing manners of Farid as acknowledged by Mr Neal contributed to this incident. The information against Mr Mangos is therefore dismissed. Mr Mangos was within the bounds of the easing down regulations, when he started this manoeuvre and he can not be blamed for the manners of Farid when this horse reacted as it did to this manoeuvre.
