Following the running of race No. 5 an information was filed. This information alleged that the starter Mr G Benton was in breach of the rules.
| -- Rules 854(3), 857(3) I, II --Following the running of race No. 5 an information was filed, this information alleged that the starter Mr G Benton was in breach of the above rules. Mr Benton did not admit the breach and was present at the hearing of this information. --The information alleged that Mr Benton, the starter for this meeting failed to call a false start when Helaman driven by Mr S Doody broke early in the run up from its front line draw. --This caused a check to Tim's Brother ( Mr Jay Abernethy), this horse lost several lengths and never regained it's correct position at the point of dispatch. --Mr Taumanu showed the video of this incident and this video showed the horse Helaman to break and come back onto Tim's Brother causing Tim's Brother to lose several lengths as alleged . --Mr Benton believed that when he noticed Tim's Brother in trouble he believed that this horse although it had lost ground it was pacing at the point of dispatch and made up ground to be just behind the field. Mr Benton stated he had not seen this incident until just before the point of no return and was happy to let the field go. --Mr Taumanu stated that there should have been a false start called as the horse Helaman had broken well before the point of no return and caused interference to Tim's Brother. Mr Taumanu estimated that Helaman had broken stride at least 30/40 meters prior to the starting point. --Decision And Reasons. --Rule 857 (3) i (ii) states Recall _Reasons For . The starter shall sound a recall for the following reasons (11) There is interference;. --It is my finding having watched the video and the evidence as presented by Mr Taumanu that interference was caused to Tim's Brother by Helaman prior to the point of dispatch and a false start should have been signaled by the starter, by not calling a false start Mr Benton is clearly in breach off the rules as alleged. Having taken into account the submissions on penalty from both parties and Mr Benton's good record a fine of $200.00 was imposed in this instance. |
