| -- Following the running of race No. 12 an information was filed, this information alleged that Mr F Cossey the driver of Lary Road drove carelessly and was in breach of rule 869 (3). --Mr Cossey admitted the breach of this rule and was present at the hearing of this information. --The information alleged that Mr Cossey the driver of Lary Road drove carelessly when he drove --Lary road into a gap where there was insufficient room to do so resulting in his horse falling and checking Festina Lente, and Cheyenne Girl this incident occurred with approximately900 meters to run. --Mr Taumanu showed the video of this incident and Mr Muirhead identified the relevant horses concerned. --Submissions were heard on penalty from both Mr Taumanu and Mr Cossey Mr Cossey had a clear driving record with no breaches of any rules. --Decision And Reasons. --Having taken into account the submissions made on penalty from both Mr Taumanu and Mr Cossey also the frank admission of the breach of this rule by Mr Cossey I order that Mr Cossey's horseman's licence be suspended up to and including the 8th of April 2005. |
