HIGHLAND STAR was disqualified.

The amended placings then read:

2nd Burt Munro
3rd  Primus Inter Pares

5th  Notre dame

Authorisation for payment of dividends and prize money was ordered to be paid on the amended placings.

Facts:

Following the running of Race 1 (Got It Covered / Baker Builders Handicap Trot 2100m) Information No. A7471 was filed with the Judicial Committee. It was alleged that the third placed horse HIGHLAND STAR broke and failed to regain its proper gait over the last 80m of the race and that it was in breach of the Breaking Horse Regulation (b).

3rd  No.12  Highland Star

Mr Muirhead advised the committee that Mr T Mitchell representing the connections did not wish to contest the protest.

Rule 870(3) provides:

Any horse which breaks from its gait shall promptly regain its proper gait.

Breaking Horse Regulation (b) provides:

Any horse which breaks from its gait within the final 200m of any race and continues on in the break for a distance of 50m or greater, shall be deemed to be in breach of Rule 870(3) in that it has failed to promptly regain its proper gait.

Submissions for Decision:

Mr Muirhead showed the video replay, identified HIGHLAND STAR and said that it had broken its gait with 80m to travel and had failed to regain its proper gait prior to the end of the race.

Reasons for Decision:

The film evidence was patently clear that HIGHLAND STAR had broken from a trotting gait to galloping with no less than 80m to travel and continued to gallop for the remainder of the race, and as such was in breach of Rule 870(3) and the Breaking Rule Regulation (b).
