Race Number:
Race 9
Decision:
Following the running of Race 9, a protest was lodged by the Stipendiary Stewards against horse number 6, Countess Jill (J Hay), placed 2nd by the Judge, on the grounds of gaining an advantage and/or through causing interference.
Following the running of Race 9, a protest was lodged by the Stipendiary Stewards against horse number 6, Countess Jill (J Hay), placed 2nd by the Judge, on the grounds of gaining an advantage and/or through causing interference.
----The Information alleged that with approximately 200metres to run, Countess Jill shifted out, checking Dram of Pernod (I Cameron), which finished 7th.
----The placings were: 1st - No 15, 2nd - 6, 3rd - 4, 4th - 9, 5th - 10, 6th - 14.
------
Introducing the protest, Chief Stipendiary Steward, Mr Escott, called the driver of Dram of Pernod, Mr Cameron. He stated that he was following Mr Hay (on Countess Jill), and he pulled off his back in the run home. He said he was getting through when Mr Hay, who was going strongly in the trail, pulled out in front of him and, as a result, he had to take evasive action. The incident was shown on the video of the race.
----Asked by Mr Escott if there was room for a run, Mr Cameron said he felt there was until Mr Hay came out, although he admitted that Mr Thornley (Ruthless Jenny) on his outside was trying to hold him down. Mr Cameron said he was going nicely at the time until he had to take hold. Asked if contact was made, he said it was not.
------
To Mr Hay, Mr Cameron agreed that the outside horse was coming down on him but he said he was still getting through alright until Mr Hay came out.
----Again referring to the film, Mr Hay said he came off the trail, waited, and then came out further. It was his view that he was entitled to come out and the other horse on the outside of Mr Cameron had contributed more than he had. Mr Cameron agreed that that horse did bear down on him.
----Decision and Reasons:
----This was a protest lodged by the Stipendiary Stewards against horse No 6, Countess Jill (J Hay), placed 2nd by the Judge, on the grounds of causing interference to horse No 1, Dram of Pernod, with approximately 200metres to run.
----Mr Cameron has given evidence that he had to take hold (of Dram of Pernod) following the outward movement of Mr Hay. He also said that the horse on the outside of him was putting pressure on him which, he agreed, he was entitled to do, to hold his ground.
----We have seen the video of the alleged interference which, in my view, tended to confirm it may have been a combination of matters which may have caused a tightening to Dram of Pernod.
----We also heard from Mr Hay and following his comments, and viewing the video, I find that there was a gradual movement outwards from Mr Hay, which he was entitled to do with safety to put his horse in the race. There was no contact made.
----I am satisfied there was also pressure on Mr Cameron from the outside horse and, consequently, I am not satisfied that the breaking of Dram of Pernod, which was taken hold of by Mr Cameron, could be attributable to Mr Hay in these circumstances.
----The protest is dismissed, and the placings remain:-
----1. 15 Belle Galleon
--2. 6 Countess Jill
--3. 4 Billy Boy
--4. 9 Hayden John
--5. 10 Adam's First
--6. 14 Ruthless Jenny
