Following the running of Race 7 on the programme, an Information was lodged against Mr I Court, the trainer of Regal Lustre, alleging a breach of Rule 864(2)(d), in that he failed to affix the removeable earplugs so as not to malfunction.

----I note, as specified on the Information, that Mr D Lethaby is acting as agent for Mr Court, that he has admitted the breach and has elected not to be present.
----Presenting his evidence, Stipendiary Steward Mr McIntyre said that, on returning to the birdcage, he had been approached by Mr De Filippi, the driver of Regal Lustre, and indicated he was unable to pull the removeable earplugs. On examination, it was found that the cord had not been attached to the loop by the earplugs but was still attached to the strap affixing the dust sheet. Thus, the earplugs could not be removed. He recommended a fine of $100.00.
----In this case, Mr Court - through Mr Lethaby - has admitted the breach and, in the absence of submissions regarding penalty, I am satisfied the recommendation from the Stipendiary Stewards is appropriate and Mr Court is fined the sum of $100.00.
