Following the running of Race 6, a protest was lodged by the Stipendiary Stewards against horse number 5, Power of Tara (S Thompson), placed 4th by the Judge, on the grounds of gaining an advantage and/or through causing interference.
Following the running of Race 6, a protest was lodged by the Stipendiary Stewards against horse number 5, Power of Tara (S Thompson), placed 4th by the Judge, on the grounds of gaining an advantage and/or through causing interference.
----The Information alleged that with approximately 700metres to run, Power of Tara broke, checking Judge Judy (L James) and Hi Rule (A Edmonds), placed 8th and 10th respectively, resulting in these horses losing all chance.
----The placings were: 1st - No 13, 2nd - 4, 3rd - 12, 4th - 5, 5th - 7, 6th - 11.
----Presenting his evidence, Chief Stipendiary Steward, Mr Escott, called Stipendiary Steward Mr McIntyre to explain the alleged interference and, in so doing, he referred to the video of the incident. He said that, with approximately 700metres to run, Power of Tara (S. Thompson) was trailing Sam Brocade (A Beecroft) and Power of Tara was being followed by Judge Judy and Hi Rule. He said that, at this point, Sam Brocade moved out slightly and Power of Tara made contact with Mr Beecroft's near wide wheel.
----Mr McIntyre indicated the movement from Sam Brocade was minimal, and it was his view that Mr Thompson anticipated the move from Sam Brocade and attempted to take a gap inside that horse when there was no room available. As a result, Power of Tara broke and checked Judge Judy and Hi Rule, causing them to lose all chance.
----Trainer Mr D Thompson agreed that his horse had caused interference but indicated he was inconvenienced himself by the actions of Mr Beecroft. He said there was deviation outwards from Mr Beecroft who, in his view, was intending on moving into the 3-wide line and, in fact, moved out into that line.
----Driver of Power of Tara, Mr S Thompson, said that it was his view that when Mr Beecroft moved out, the gap between Sam Brocade and the inside horse was large enough for him to put his horse's legs into the gap and then Mr Beecroft pulled back and came back in, his wheel clipping Power of Tara's legs and causing him to break.
----Decision and Reasons:
----This was a protest lodged by the Stipendiary Stewards against horse No 5, Power of Tara (S Thompson), placed 4th by the Judge, on the grounds of causing interference to horses No 9, Judge Judy and 15, Hi Rule.
----Evidence from Mr McIntyre, referring to the film of the incident, showed the positions of the respective horses. It showed that, at about the 700metre mark, Power of Tara moved on the inside of Sam Brocade (S Beecroft) and broke when, driver Mr Thompson inferred, that horse appeared to move outwards into the 3-wide line. Whether Mr Beecroft was moving into the 3-wide line is only conjecture as he hasn?t been called to this hearing.
----Be that as it may, I am satisfied from the evidence of the film, and hearing from the Stipendiary Steward, that the movement from Sam Brocade was minimal. In fact, I note that after a slight outward movement, driver Beecroft actually strives to ensure his horse is trailing the horse in front.
----Whilst Mr Thompson may have anticipated a full outward movement, I am satisfied that did not occur. I do not agree with his view that there was sufficient room for him to move inside Mr Beecroft and I find that, as a result, contact was made, causing his horse to break, with resulting interference to those trailing horses, Judge Judy and Hi Rule. I do not accept trainer Mr Thompson's assertion that Sam Brocade was half-carting.
----In this matter, I have to determine if interference occurred. In the circumstances, I am satisfied that it did, and that the chances of Judge Judy and Hi Rule were affected by the actions of Power of Tara and, as a result, lost their chance in the race. Consequently the protest is upheld and Power of Tara is relegated to 10th behind Hi Rule.
