As Miss Williams, had admitted the breach, the charge was found proved.

Penalty:

Accordingly, Miss Williams Class A Jockeys licence is suspended from the conclusion of racing 11 January up to and including 17 January 2020.

Facts:

Following the running of Race 1, an Information was filed by Stipendiary Steward, Mr M Davidson, against Class A Rider, Miss K Williams, the rider of IWONDERWAI, alleging careless riding near the 1200m, in that she permitted her mount to shift inwards when not sufficiently clear of TORMUND which was checked resulting in SUPERTAP and NICOLE ASHLEY being hampered.

Rule 638(1)(d) reads as follows:

“(1) A Rider shall not ride a horse in a manner which the Judicial Committee considers to be:
      (d) careless”

Miss Williams had indicated on the Information that this breach of the Rules was admitted, which she confirmed at the hearing. Miss Williams also agreed that she understood the charge and the Rule it was brought under.

Mr Davidson, with the assistance of Chief Stipendiary Steward, Mr J Oatham, gave evidence and used video coverage to show that approaching the 1200m and the bend out of the straight, Miss Williams riding IWONDERWAI was racing 4 wide with TORMUND, ridden by Mr L Callaway and OCEANS AWAY ridden by Mr J Laking, racing on her inside.

Mr Oatham showed on the replays Miss Williams shift inwards when only a bare length ahead of TORMUND causing that horse to check. As a result, the trailing runners SUPER TAP and NICOLE ASHLEY were hampered. Of note he said that OCEANS AWAY did not handle the bend out of the straight and contributed to the incident.

Miss Williams stated that OCEANS AWAY did not handle the bend and ran out, contributing to the incident. She added that shortly after the incident, the film showed that she was still out in an approximate 3 wide position with room inside her.

Submissions for Penalty:

Mr Davidson stated that Miss Williams’ penalty record was an excellent one with no offences of this Rule showing over the previous 12 months. Mr Davidson stated that the breach was low to mid and suggested that a 7 National day starting point was appropriate in this case. He added that consideration be given to her admission of the breach and her excellent record.

Miss Williams elected to make no submissions on penalty. She requested a deferment until after racing 11 January 2020.

Reasons for Penalty:

The JCA Penalty Guide provides a starting point of a 6-day suspension for a low range breach and a starting point of an 8-day suspension for a mid-range breach. We agreed with Mr Davidson that this breach was low to mid and accordingly adopted a 7-day starting point. There were no aggravating factors to consider, therefore no uplift in penalty warranted. We researched our penalty records which revealed that Miss Williams had a clear record under this Rule for nearly 2 years. We therefore were able to afford Miss Williams a combined discount for her exceptional record and her frank admission of the breach. This discount we set at 2 days. We therefore determined that a 5-day suspension was an appropriate penalty in this case.
