Following the running of Race 11, PGG Wrightson Rating 90, Information No. 5536 was filed by Stipendiary Steward, Mr M R Davidson, against Licensed Jockey, Mr C W Johnson, alleging a breach of Rule 638 (1) (d) in that Mr Johnson “allowed his horse SHOW CAT to shift out when not clear causing KALGOORLIE BOMBER (M Carston) to check. This incident happened about the 200 metres mark”.

DECISION AND REASONS:
Following the running of Race 11, PGG Wrightson Rating 90, Information No. 5536 was filed by Stipendiary Steward, Mr M R Davidson, against Licensed Jockey, Mr C W Johnson, alleging a breach of Rule 638 (1) (d) in that Mr Johnson “allowed his horse SHOW CAT to shift out when not clear causing KALGOORLIE BOMBER (M Carston) to check. This incident happened about the 200 metres mark”.

Mr Johnson was present at the hearing of the information and indicated that he admitted the breach. The breach was found proved accordingly.

--

Rule 638 provides as follows:
(1) A Rider shall not ride a horse in a manner which the Judicial Committee considers to be:
 (d)   careless.

--

Mr J M McLaughlin, Stipendiary Steward, showed video replays of the final stages of the Race. He pointed out Mr Johnson on SHOW CAT, towards the rear of the field and on the inner, with KALGOORLIE BOMBER on his outer. There was room for Miss Carston. Mr Johnson was riding his mount with the whip. His mount “rolled out” and Miss Carston had to check and ease out of the gap that she was in.

Mr Johnson said that he had admitted the charge because he had allowed his mount to “shift fractionally” – half a horse width at least, he said. He submitted that Miss Carston had not had to check badly and had not been badly affected in the incident. It had been “battling” at the time, he submitted.

In relation to penalty, Mr Davidson informed the Committee that Mr Johnson had last been suspended for careless riding in October 2009 (4 days) and, prior to that, had received a 7 days’ suspension in September 2009. Mr Johnson is a very busy rider and has been riding regularly over the Christmas season in both the North and South Islands. The Stewards saw the breach as being in the “mid to low range”. Mr Davidson recommended a term of suspension of not more that 4 days.

Mr Johnson informed the Committee that he had riding engagements in the next 7 days’ period and he sought a deferment, pursuant to Rule 1106 (2), for a 7 day period. The Stewards had no objection to a deferment, Mr Davidson said.

In determining penalty, the Committee took into account Mr Johnson’s admission of the breach and his relatively good riding record. The Committee agreed with Mr Davidson’s assessment of the degree of carelessness as being in the mid to low range.

--

Taking those matters into account, the Committee suspended Mr Johnson’s licence from the conclusion of racing on Saturday, 23 January 2010, up to and including 28 January 2009 – effectively 3 days.
