Following the running of Race 11, PGG Wrightson Rating 90, Information No. 5536 was filed by Stipendiary Steward, Mr M R Davidson, against Licensed Jockey, Mr T R Moseley, alleging a breach of Rule 638 (1) (d) in that Mr Moseley “allowed his mount [PETER PORTER] to move inwards when not clear causing ENVEE (C L Spittles) to check near the 150 metres mark”.

DECISION AND REASONS:
Following the running of Race 11, PGG Wrightson Rating 90, Information No. 5536 was filed by Stipendiary Steward, Mr M R Davidson, against Licensed Jockey, Mr T R Moseley, alleging a breach of Rule 638 (1) (d) in that Mr Moseley “allowed his mount [PETER PORTER] to move inwards when not clear causing ENVEE (C L Spittles) to check near the 150 metres mark”.

Mr Moseley was present at the hearing of the information and indicated that he admitted the breach. The breach was found proved accordingly.

--

Rule 638 provides as follows:
(1) A Rider shall not ride a horse in a manner which the Judicial Committee considers to be:
 (d)   careless.

--

Mr J M McLaughlin, Stipendiary Steward, showed video replays of the final stages of the Race. He pointed out Mr Moseley on PETER PORTER challenging for the lead with about 150 metres to run. At that point, Mr Moseley, riding with the whip, allowed his mount to shift ground inwards as a result of which Miss Spittles on ENVEE had to check out of the gap. Mr McLaughlin said that the Stewards conceded that Miss Spittles did receive a “bump” from the horse on its inside, HIT THE BIT (J L Morris), just prior to Mr Moseley’s inwards movement.

Mr Moseley submitted that the leader on the fence, SLAH (D W Stackhouse), had shifted out slightly and had dictated Miss Spittles’ line briefly. This had contributed to the incident, Mr Moseley said. Mr Moseley said that his mount had lugged in but he admitted that he was “a little bit late” in stopping riding with the whip.

Mr Davidson agreed that Mr Moseley had been “one stride” late in straightening his mount. The breach was in the low to mid range, he said. Mr Moseley had an “excellent” record – no breaches of the Rule in the last 12 months. He was a senior South Island rider and one of the busiest, having ridden extensively over the Christmas period. He recommended a term of suspension of not more than 3 days.

 Mr Moseley informed the Committee that he had riding engagements in the next 7 days’ period and he sought a deferment, pursuant to Rule 1106 (2), for a 7 day period. The Stewards had no objection to a deferment, Mr Davidson said.

Mr Moseley said that he had been offered a ride at Wellington on 25 January and may stay in the North Island to ride at Hawkes Bay on 27 January.

--

In determining penalty, the Committee took into account Mr Moseley’s admission of the breach and his excellent riding record. The Committee agreed with Mr Davidson’s assessment of the degree of carelessness in this case as being in the low to mid range.

--

Taking those matters into account, the Committee suspended Mr Moseley’s licence from the conclusion of racing on Saturday, 23 January 2010, up to and including 28 January 2009 – effectively 3 days.
