The Committee ruled that "Shesalljazz" be declared a non-starter.

Facts:

Following the running of Race 6, Greymouth Star Maiden, an information requesting a ruling was filed by Stipendiary Steward, Mr M Davidson, pursuant to Rule 632 as to whether "Shesalljazz" (L Robinson), was denied a fair start when the gate did not open.

Ms K Beckett, the Trainer's Representative, was present at the hearing of the information.

Rule 632 provides as follows:

"If, in the opinion of the Judicial Committee, a horse which does not finish in the first three placings was prevented from taking an effecetive part in a Race owing to the mechanical failure of starting stalls, or is denied a fair start and such occurence materially prejudiced the chances of that horse "but not where the horse is slow away by its own accord), the Judicial Committee may declare such horse to be a non-starter."

"Shesalljazz" did not finish in the first three placings.

Submissions for Decision:

Mr Davidson showed a rear-on video replay of the start of the race.  He pointed out "Shesalljazz' (L Robinson), drawn the inside barrier in the ten horse field at the 1100 metres start.  He submitted that it was quite clear from the video replay that "Shesalljazz"'s gate failed to open and that the horse had to push the gate to open it.

Mr Davidson submitted that "Shesalljazz" had lost "significant ground" as a result of its gate failing to open.  The video replay showed that the horse had lost several lengths and was in last placing when the field left the barriers.

He submitted that "Shesalljazz" should be declared a non-starter.

Mr L Robinson, the rider of "Shesalljazz" told the hearing that his mount's head hit the barrier gate with some force, and he felt that it may have been stunned by the impact, as he had some problems with it going around the first bend.

Ms Beckett stated that she agreed that the horse should be declared a non-starter.

Reasons for Decision:

The Committee was satisfied that the gate of "Shesalljazz" had failed to open on terms with the rest of the field through a mechnical failure.  Further, the Committee was satisfied that "Shesalljazz" was thereby prevented from taking an effective part in the race - it had to force its way out of the barrier and, clearly, lost several lengths as a result.  The horse was not slow away of its own accord.
