As Miss Lunn has admitted the charge it is therefore deemed to be proved.
Penalty:
We take as a starting point for penalty, a supension of 5 days. In this case there are no particular aggravating features which would warrant an uplift on our starting point. However, there are mitigating features which will allow us to allow a discount on our starting point. Miss Lunn has a good career riding record. She is an apprentice who rides in the South Island only. She has admitted the charge at an early stage. We accept her evidence that she had a strong mount to contend with and that the interference to Mr Bullard's mount was not that significant. We also note the stage of the race at which the interference occurred which did not in the overall circaumstances affect Mr Bullard to any great extent (he went on to finish second).
Therefore we allow a discount on our starting point of 3 days making the suspension that of 2 days. The suspension will come into effect as from the close of racing on Saturday 14th January 2012 and will conclude at the conclusion of racing on Thursday 26th January 2012. That period of suspension will preclude Miss Lunn from riding at the meetings at Gore on 21st and 26th January 2012.
Charge:
Alleged that Miss Lunn (One Chance) allowed her mount to shift in crowding Second Hope (J Bullard) who had to be checked passing the 1200 metres.
Facts:
Stipendiary Steward Mr A Ray showed the hearing the incident which led to the charge, on the video coverage from the head-on and side-on views. At the 1200 metre mark or thereabouts, Miss Lunn was riding approximately 2 off the fence. Mr Bullard was on her inside about one horse width off the fence, but slightly behind Miss Lunn. Miss Lunn who was beginning to run on in a forward position, appeared to have looked to her inside before moving inwards. However, in the process she was not her own horse length and another length clear which Miss Lunn accepted happened. The result was that Mr Bullard's mount received some interference and he had to check his horse off Miss Lunn's horse's heels.
In explanation, Miss Lunn said that she had strong horse to contend with and that she under instructions not to lead in the early stages of the race, so she had a hold on her mount. She thought she was clear when she looked for the second time but did not realise that the incident had happened. Mr Harris, Miss Lunn's employer said that Miss Lunn was possibly fractionally slow in looking before she crossed over.

It was submitted that Miss Lunn's carelessness lay in moving across the line of Second Hope when not her own horse length and another length clear.

Mr Ray advised the hearing that Ms Lunn has not been suspended for careless riding in the last 12 months. She is an apprentice who rides regularly at race meetings. He said that she was always co-operative with the Stewards and should be given credit for her early admission of the charge. He submitted that a suspension of 2-3 days should be imposed. He said that in the Stewards opinion the carelessness was at the lower end of the scale.
Miss Lunn accepted that a suspension was inevitable. She advised the hearing that she does not have any riding engagements in the next 7 days and therefore was not applying for a deferrment.
Reasons for Penalty:
